Dalam nada puitis, rembulan sembunyi dibalik awan adalah halwa telinga. Malang sekali untuk tahun 2008 ini, Malaysia tidak ada masa untuk puisi. Keadaan negara jadi sedikit kelamkabut untuk sesiapa bersantai, terlentuk dan melayan hati dengan puisi. Terpaksalah rakyat jadi pemerhati kepada insiden-insiden yang berat, mendebarkan, dan pada masa yang sama dipaksa memikul tanggungjawab ke atas kenaikan harga minyak. Ini adalah realiti.

Ketika Abdullah membuka negara ini dengan "keterbukaannya", ada pula yang lari lintang pukang bersembunyi. Sebahagian dari cerita bersembunyi kekal sebagai cerita, selebihnya adalah real dan jadi berita.

1. Lebihkurang 60,000 rakyat terengganu menunggu dari pintu masuk bangunan lapangan terbang sehingga ke kem Askar Melayu Di Raja Seberang Takir, bagi menunjukkan sokongan kepada Yang DiPertuan Agong dalam kes penderhakaan UMNO terhadap Sultan Terengganu selepas PRU12. Dalam krisis perlantikan Menteri Besar Terengganu, rakyat keluar beramai-ramai menyatakan sokongan dan taat setia kepada Raja mereka. Berkumandanglah laungan "Daulat Tuanku" di Terengganu. Sementara itu Idris Jusoh dan Rasool (yang dianggap oleh sesetengah pemerhati sebagai Penderhaka) tidak kelihatan dan dikatakan bersembunyi atau menghilangkan diri.

2. Pada 28 Jun baru-baru ini, Saiful Bukhari Azlan membuat laporan polis mengatakan Dato Seri Anwar Ibrahim, Penasihat Parti Keadilan Rakyat, telah meliwatnya beberapa kali. Anwar yang menghadapi tuduhan liwat kali kedua dalam karier politiknya dikatakan mendapat perlindungan di Kedutaan Besar Turki, di ibu kota. Keesukannya Presiden PKR, Datin Seri Azizah berkata suaminya terpaksa "bersembunyi" setelah menerima ugutan seminggu lepas.

Azizah juga berkata beliau berunding dengan peguamnya mengenai keperluan mendapatkan suaka politik untuk Anwar.

3. Raja Petra Kamarudin pula telah memaparkan laporan perubatan oleh Dr Mohamad Osman Abdul Hamid daripada Hospital Puspawari, dalam laman siber. Pendedahan tersebut mendapat reaksi pelbagai dari lapisan masyarakat Malaysia. Dimaklumkan bahawa Saiful telah terlebih dahulu berjumpa dengan Dr Mohamad Osman sebelum ke Hospital Kuala Lumpur berkaitan dengan aduan liwat. Kini dimaklumkan Doktor berkenaan telah menghilangkan diri bersama ahli keluarganya. Ada pula yang berkata mereka bersembunyi.


4. Parti Keadilan Rakyat menolak kabar angin Zulkifli Noordin Ahli Parlimen Kulim yang menyertai demonstrasi membantah forum umum Majlis Peguam, sengaja diarah menghilangkan diri bagi mengelak beliau menjadi isu menjelang pilihanraya kecil Permatang Pauh. Ada laporan mengatakan Zulkifli bersembunyi dan berada dalam keadaan selamat bersama orang yang dikenali dan beliau sihat.

Dalam kemelut aftermath forum itu, Zaid dinanti-nanti untuk muncul dan memberi komen kerana majlis peguam adalah dalam bidang portfolio beliau. beliau juga dikatakan bersembunyi dan mengunci mulut. Keadaan itu ketara berbeza dengan langkah "membersihkan" Tun Abbas Saleh sebelumnya.


5. Datuk Bakri Zinin pula telah memaklumkan Interpol dan negara-negara jiran berkaitan kehilangan Balasubramaniam. Tidak berapa lama selepas itu, polis mengesahkan Bala sudah dikesan bersembunyi disebuah negara dan berada dalam keadaan selamat. Bala telah menggemparkan Malaysia bila mengemukakan 2 Pernyataan Bersumpah yang kontradiktori berturut hari.

6. Presiden PAS, Dato Seri Hadi Awang tidak lagi bersembunyi bila menegaskan akan keluar Pakatan Rakyat jika Islam dipinggirkan oleh Kerajaan Pakatan Rakyat yang bakal ditubuhkan pada 16hb September ini. Sinar Harian pula melaporkan PAS mahu Dato Seri Abdul Hadi Awang jadi Perdana Menteri jika Pakatan Rakyat merampas kerajaan dari Barisan Nasional.

Tali penamat untuk Abdullah, Tali pengikat untuk Najib.

Dato Ron, harap sihat selalu.

Dulu, Tun tanpa amaran awal, mengumumkan pengunduran serta merta dari kepimpinan negara dalam Dewan Perhimpunan UMNO. Dewan terpaku dan bukan sedikit yang menangis.

Abdullah pula pada waktu selepas sedikit reda, menjerit sekuat-kuat hati "Kami minta Presiden tarik balik!".

Selepas itu Tun berundur beransur-ansur.

Kini tiba giliran Abdullah pula. Tidak ada yang menangis. Tidak ada yang terkinja-kinja minta Abdullah jangan undur.

Bila pengumuman dibuat sebelum Pemilihan Umno, ramai menjangka ia hanyalah untuk memastikan setiap cawangan dan bahagian mencalonkan tokoh dermawan yang sudi melepaskan takhta emas pada timbalannya dalam tempuh 700 hari dari sekarang.

Tali penamat masih jauh di depan. Kes Razak Baginda juga belum tiba kepenghujungnya. Rakyat juga tahu BPR menyiasat Musa Hassan dan Gani Patail. RPK dan Balasubramaniam turut menambah warna pelangi politik. Anwar pula masih mengejar Publisiti. Rakyat tetap patriotik memikul beban inflasi.

Kita belum nampak tali pita untuk Abdullah tunduk mendada dan menumbuk angin tanda tamatnya perlumbaan. Tapi kita seakan-akan nampak tali yang mengikat kaki Najib dari bebas kemana-mana.

Masakan rakyat tidak tahu.

GOMBAK - MALAYSIAN private investigator P. Balasubramaniam's house in Taman Pelangi here was broken into but police have yet to ascertain if anything had been stolen.

According to a neighbour, Ms M. Eswary, a Form Four student, she noticed the back grille gate of Mr Balasubramaniam's house was ajar at 2.30pm on Thursday.

'I went to inspect and found the gate and a door leading to the kitchen opened. There was a set of keys each hanging on the padlock gate and the door,' said Ms Eswary, who alerted her father M. Sadasuvam, who later made a police report.

Mr Balasubramaniam is said to have taken refuge in a neighbouring country with his wife and children.

Gombak police chief Asst Comm Abdul Rahim Abdullah said police were unable to ascertain what was stolen from Mr Balasubramaniam's house and that the burglars used a duplicate set of keys to gain entry.

Last Thursday, Mr Balasubramaniam rocked the nation with a statutory declaration alleging that Deputy Prime Minister Datuk Seri Najib Tun Razak had an affair with murdered Mongolian Altantuya Shaariibuu. He was then represented by lawyer Americk Singh Sidhu.

However, in a press conference called less than 24 hours later, he made a second statutory declaration retracting all those allegations. He even appeared with a new lawyer.

Immediately after the press conference, he left with that lawyer and was never seen or heard by anyone. -- The Star/ANN.

Americk Sidhu Singh terserempak dengan Balasubramaniam di restoren

Americk said he and Balasubramaniam met by chance at a restaurant about two months ago.

"Nobody introduced us and it was during our conversation that the subject of the statutory declaration (SD) was brought up.

"Balasubramaniam later engaged me as his lawyer, which was when I documented his SD," he said.
The lawyer said it had never crossed his mind to charge Balasubramaniam a fee as he merely assisted the private investigator in preparing the SD.

"The question of opening a file did not arise because I was not representing Balasubramaniam in a court case."

He added in view of the recent developments, his task was not over.

On the police report he lodged yesterday, Americk said it was to clear his name and for the safety of his client.

The lawyer pointed out that when Balasubramaniam retracted his first SD, he had said that the sworn statement was made "under duress".

"The retraction amounts to criminal defamation of my character, both personally and professionally. It implied that I forced him to come out with the SD. I have to clear my name."

Americk said his report also called for police to conduct an investigation to ascertain who were the people who forced Balasubramaniam to file his first SD.

Walaupun begitu, waktu kenyataan akhbar untuk akuan bersumpah yang pertama, Balasubramaniam berkulit gelap amat jelas kelihatan,tetapi yang kulit cerah sedikit seperti Anwar Ibrahim, Azmin, Americk Singh Sidhu, Saifuddin Nasution dan Chan Tian Chua juga tidak kurang menonjol kehadiran mereka.

Dari awal lagi Akuan Bersumpah telah dimainkan sedemikian rupa. Impak yang maksimum untuk publisiti. Anwar Ibrahim seperti yang sudah-sudah dilihat hidup dengan politik berCANDUkan publisiti.

Publisiti tidaklah salah. Yang salah dan malang adalah CANDU.

KUALA LUMPUR: Umno Youth will counter every accusation against party leaders by Datuk Seri Anwar Ibrahim, its chief Datuk Seri Hishammuddin Hussein said.

In a statement yesterday, Hishammuddin said Umno had had enough of Anwar's "lies, accusations and nonsense" and would not stand idly by as he slandered party president Datuk Seri Abdullah Ahmad Badawi and deputy Datuk Seri Najib Razak."Anwar's accusations against our leaders are to divert attention from the new sodomy allegations against him."We will mobilise our members all over Malaysia to meet the public, we will explain and rebut every accusation by Anwar and prove that it is nothing but a bunch of lies."On Thursday, Anwar endorsed a statutory declaration by Razak Baginda's former private investigator, P. Balasubramaniam, linking Najib with murdered Mongolian Altantuya Shaariibuu.

Yesterday, however, Balasubramaniam retracted his sworn statement, saying that it was made under duress."The withdrawal of the sworn statement proves that it was all just a big lie concocted by Anwar. "It also shows that Anwar is good at playing dirty politics," Hishammuddin said.

Joining Hishammuddin in the attack on Anwar was Putera Umno chairman Datuk Abdul Azeez Abdul Rahim, who accused Anwar of attempting to settle his latest sodomy allegations through a trial by media.

"If Anwar is indeed innocent of sodomy then let him prove it in court. He shouldn't shift the spotlight off himself by hurling baseless and hurtful accusations at our national leaders through the media," Abdul Azeez said."I support Perak Mufti Dr Mohd Asri Zainul Abidin's suggestion that we settle this sodomy allegation in an Islamic fashion."Let Anwar and Mohd Saiful Bukhari Azlan (his accuser) both appear at Masjid Negara, swear on the Quran and tell the truth."

Bala could face perjury charge

PETALING JAYA: A statutory declaration is evidence given under oath which cannot be retracted, said a serving judge and several senior members of the legal fraternity.

They believed private investigator P. Balasubramaniam’s act of retracting his initial declaration, which made serious accusations against Deputy Prime Minister Datuk Seri Najib Tun Razak, could open the former to perjury charges.

According to the judge, who is an authority in criminal law, affirming a statutory declaration was akin to giving evidence in court.

“Under the normal rule of evidence, one cannot withdraw it unless he has very strong reasons. Those reasons must be included in the withdrawal or else he would be committing perjury,” he said.

He said if one was citing duress as a reason for making false accusations in a statutory declaration, he must present proof of such pressure.

“He must show that the pressure was serious like it’s life-threatening to him or his family members.

“He cannot just say that he is withdrawing the statutory statement because he had earlier been forced to do it. Someone can now lodge a police report against him and he could face a perjury charge,” he said.

Balasubramaniam announced yesterday that he had retracted the entire content of his statutory declaration that alleged police had omitted vital information in the Altantuya Shaariibuu murder case barely 24 hours after he made it public on Thursday.

Bar Council chairman Datuk Ambiga Sreenevasan said a statutory declaration was basically evidence on oath that, once given, could not be retracted.

She, however, said a person could add or correct the statutory declaration to file a further declaration.

“Because it is evidence on oath, and if there are untrue statements, then there is the possibility of a person having given a false statement.”

Bar Council’s criminal law committee deputy chairman Datuk V. Sithambaran said that under the law, two inconsistent statements meant that a person had most likely committed perjury.
“Such an act under the case law suggests that a person is guilty of perjury,” he said.

Senior lawyer Roger Tan said once a statutory declaration was made it could not be cancelled midway because it was a sworn statement of fact.

Tan said Section 3 of the Statutory Declarations Act 1960 provided that a false declaration was punishable.

Veteran lawyer Karpal Singh said the retraction amounted to an offence under Section 193 of the Penal Code.

“Under the section, making a false statutory declaration carries the penalty of not more than seven years' imprisonment or fine or both,” said the DAP chairman.
