All eyes on MACC, JAC Bills

FINALLY, the much talked-about proposed laws touted as being part of the reforms being instituted by Prime Minister Datuk Seri Abdullah Ahmad Badawi before he leaves office were presented to the Dewan Rakyat on Wednesday.

And it was to give him time to carry out the reforms – the passion for which intensified greatly after the March 8 general elction – that the Umno general assembly and the party elections have been postponed from December to March.

To demonstrate how close to his heart these reforms meant to him, Abdullah came to the Dewan Rakyat – where he had been absent for sometime because of his busy schedule – to table the Malaysian Anti-Corruption Commission Bill (MACC) and the Judicial Appointment Commission Bill (JAC) himself.

The proposed laws will create new bodies – originally thought to be independent agencies – to oversee judicial appointments and fight corruption more effectively so that Malaysia will be a better place for all. But typical of Malaysians, they – or at least their representatives in the Dewan Rakyat – are already discussing the merits and demerits of the bills and whether they are what were promised earlier.

The Dewan Rakyat will only be debating the bills next week but already MPs from the BN and Pakatan Rakat are discussing them in the Members Lounge and in lobby.

On the surface, all BN MPs are saying the bills are likely to restore public and investor confidence in the country’s judicial system and taking the battle against corruption to a higher level.

Some of them, however, share the views of some of the opposition members.

They do not see how the bills, in the forms presented, would change public perception about corruption, or raise confidence in the judicial system.

They do not see how the agencies to be set up would be independent when the prime minister still exerts a lot of influence in their functioning.

With time to study the bills, it would be interesting how they are going to be debated next week.

It was an interesting one hour of debate on an emergency motion by Azmin Ali (PKR-Gombak) to discuss the Bukit Antarabangsa landslide that took four lives on Saturday. No one was really surprised that Speaker Pandikar Amin Mulia allowed it.

"We want all those responsible for approving the project to be prosecuted," thundered Azmin. A few of the Pakatan Rakyat MPs also stood up to lambast the BN, especially the previous Selangor government, for approving the hill slope projects.

Some of them must have felt funny that despite their provocations, the BN backbenchers did not respond with their usual broadsides. Those who stood to speak did so quite civilly.

Minister of Housing and Local Government Datuk Seri Ong Ka Chuan, in his response to Lim Guan Eng (DAP-Bagan), admitted that there were sufficient laws governing approvals for projects but the problem was enforcement.

He said a preliminary report on what happened at Bukit Damansara would be ready next month but may not be made public but the full report on what actually happened on the morning of Saturday would only be ready in three months.

Two interesting disclosures were made during this week’s meeting. On Wednesday, the prime minister in his written reply to Liew Chin Tong (DAP-Bukit Bendera) said the government spends RM6 million a month on rental and maintenance on his official residence in Putrajaya. The money is paid to Putrajaya Holdings.

On Thursday, Foreign Minister Datuk Seri Syed Hamid Albar said the government owned about RM3.6 billion worth of properties overseas, mainly buildings housing the country’s foreign missions abroad.

M'sia harmed by corruption

MALAYSIA'S reputation for being ridden by corruption is harming the country's prospects, Prime Minister Abdullah Ahmad Badawi said on Wednesday as a new anti-graft body was tabled in parliament.

Mr Abdullah also tabled legislation that will appoint a nine-member panel to advise the premier on the selection of judges, in a bid to address criticism that the judiciary is corrupt and incompetent.

'It will give a level of confidence in these institutions, higher than before, and negative perceptions will hopefully be reduced as much as we can,' Mr Abdullah said of the two proposals.

'We have to deal with the perception by businesses and industry that corruption here is king, and the judiciary is unsatisfactory and is not credible as all of this will affect our competitiveness,' he told reporters.

The Anti-Corruption Agency which is being replaced has been criticised as toothless, and the new version is being promoted as having more independence and greater accountability.

However, activists say that the new commission should be also given the power to prosecute corrupt activities, currently the responsibility of the government.

Mr Abdullah has been forced to agree to stand down in March and hand over to his deputy Najib Razak, after the government was punished in general elections this year over his failure to introduce promised reforms.

The premier came to power in 2003 with grand plans to revamp the police and the justice system, and root out corruption from the ruling party, but his failure to act earned him a rebuke at the March polls.

Time running out for Abdullah to reform judiciary

Prime Minister Datuk Seri Abdullah Ahmad Badawi has placed judicial reform at the top of his must-do list before handing over power to his deputy Datuk Seri Najib Razak next March. But unless he pushes for sweeping changes at the Attorney-General's Chamber, the powerful office of the Malaysian government's chief legal adviser and prosecutor, lawyers and political analysts say Abdullah's pledge will join the long list of unfulfilled promises that has come to distinguish his premiership.

“The government needs to review the vast scope of the AG's powers and bring more transparency to the office. Without this, whatever reforms will be cosmetic at best,” says Datuk Zaid Ibrahim, the country's former de facto Law Minister. He resigned from the Cabinet recently because of the opposition he faced from within the government to bring about reforms in the judiciary and the national legal system.

Unease over the AG Chambers is a widely share sentiment among many Malaysians. But that these things are now being said by a one-time member of the Abdullah administration underscores the growing concerns over the country's justice system.

Close associates of Abdullah say the Premier is aware that he needs to push for an overhaul of the AG's Chambers. But, like Zaid, he, too, is facing opposition from several senior Cabinet members and the current Attorney-General Tan Sri Abdul Gani Patail, associates say.

“The PM knows what needs to be done but he has yet to indicate how far he plans to go with the overhaul of the AG's office,” says a close associate of Abdullah, who has been involved in private discussions about judicial reforms.

The powers of the AG have long been a subject of debate, particularly because he has the sole discretion to initiate or discontinue legal proceedings in any case other than religious ones.

These powers, coupled with his role as the government's chief legal adviser, have often led to accusations of conflict of interest, especially in cases where the AG must decide whether to institute criminal proceedings against members of government.

The political dimensions of several high-profile cases in Malaysia over the past decade — such as the cases against opposition leader Datuk Seri Anwar Ibrahim — have led critics to allege that the government has used the AG's Chambers to go after its opponents. PETRONAS has contributed RM62.8bil or 44% of the Govern­ment’s revenue this year, Prime Mi­nister Datuk Seri Abdullah Ahmad Badawi said in his written reply to Fong Kui Lun (DAP – Bukit Bintang).

He said the Government would continue to own Petronas as it was the largest revenue contri­butor, and that the company would not be listed on the Kuala Lumpur Stock Exchange.

However, four of its subsidiaries – Petronas Dagangan Bhd, Petronas Gas Bhd, MISC Bhd and KLCC Property Holdings Bhd – are listed on the stock exchange, he said.

Meanwhile, Second Finance Minis­ter Tan Sri Nor Mohamed Yakcop, when winding-up the debate on his ministry at the committee stage later, said the main bondholders of Value­Cap Sdn Bhd have agreed to refinance the RM5.1bil loan taken from the Employees Provident Fund (EPF).

He also gave an assurance that the loan, which was due by February next year, would not be used to repay ValueCap’s outstanding loans.

“The loan will remain a loan. EPF is not holding any equity in ValueCap, there is no risk to EPF contributors and the loan is fully guaranteed by the Government,” he said.

He said ValueCap’s main bondholders – the Pensions Trust Fund Council, Khazanah Nasional Bhd and Permo­dalan Nasional Bhd – had agreed to the refinancing programme, while ValueCap would also pay the loan interest during the same period.

He said ValueCap, which was established by the ministry to invest in undervalued stocks on the local bourse, would invest in stocks with strong fundamentals and high economic potential.

KUALA LUMPUR, Nov 11 (Reuters) - The Malaysian government has no plans to float state-owned oil company Petronas [PETR.UL], given its massive contributions to the national exchequer, Prime Minister Abdullah Ahmad Badawi said on Tuesday.

"The government will ensure Petronas continues to remain as a state-owned corporation," Abdullah said in a written response to a query by an opposition MP, state news agency Bernama said.

The MP had sought the government's response following a call by the Malaysian Investors' Association to float part of Petronas' shares on the local bourse for public ownership.

Petronas is the biggest contributor to the government's coffers, adding about 62.8 billion ringgit ($17.54 billion), or 44 percent of the government's total revenue, in 2008, Abdullah said.

Four of Petronas subsidiaries -- Petronas Dagangan Bhd (PETR.KL: Quote, Profile, Research, Stock Buzz), Petronas Gas Bhd (PGAS.KL: Quote, Profile, Research, Stock Buzz), MISC (MISC.KL: Quote, Profile, Research, Stock Buzz) Bhd and KLCC Property Holdings Bhd (KCCP.KL: Quote, Profile, Research, Stock Buzz) -- are already listed on Bursa Malaysia, he said. PM: ‘I’m not backing Ali Rustam for Umno dep president.’

Umno President Datuk Seri Abdullah Ahmad Badawi denied he was throwing his support behind Datuk Seri Mohd Ali Rustam to be the new party deputy president.

Asked if his comments in Sabah recently on Mohd Ali were an indication to divisions not to pick Tan Sri Muhyiddin Yassin who has been very vocal, Abdullah said: “No no. That’s not right.”

Saya ingin kaitkan kenaikan Zaki Azmi dalam struktur kehakiman negara. Dari seorang lawyer biasa, beliau dilantik sebagai hakim peringkat atas dan kini bersedia untuk memikul tanggungjawab sebagai Chief Justice!

Tahun 2007, Pak Lah belum terfikir judicial reforms dalam konteks laluan khas untuk Zaki. Dari sudut ini sahaja kita dapat melihat multi-faces Pak Lah.

Ada yang utarakan bahawa sebaik judicial reforms ala Pak Lah termetrai, kerajaan terlepas punca kawalan. Suara Bar Council akan kuat dan menghimpit. Adakah semua ini Pak Lah atau semata-mata Zaid? Jangan lupa linggamgate pencetus kepada keghairahan judicial reforms. Linggamgate adalah bikinan ANWAR!

Dari sudut judicial reforms sahaja, Pak Lah sudah berbeza dengan Tun Mahathir. Grip atau kawalan dilepas sesuka hati.

Seperti ada orang yang kesian melihat ayam sihat dalam reban, lalu membuka pintu reban supaya ayam dapat lihat dan rasa dunia luar. Orang itu lupa, bagaimana mahu pastikan ayam kembali petang nanti. Strategic thinking tidak berlaku. Pelik dan membimbangkan.

Banyak lagi insiden yang serupa berlaku. Longgokan peristiwa sedemikian menjadikan Pak Lah dilihat mengecewakan.

Reban ternganga luas, ayam entah kemana.

Oleh yang demikian Pak Lah tidak akan kenal siapa Tun Mahathir sampai bila-bila.

SOME Umno leaders are agitating for an earlier exit date for Prime Minister Abdullah Badawi, just a week after top leaders agreed that he should retire by the end of March.

The views from the restive ground were reflected by comments from party vice-president Muhyiddin Yassin.....

He told reporters on Thursday that the four-month campaign period for the party election was too long and that many members felt likewise, in a none-too-subtle hint for Datuk Seri Abdullah to step down earlier.

'I am saying this because there are many who share the same concern because there can be the issue of money politics and will drain resources like energy and funds.

'The campaign period is the longest in years and has never happened before. All this because we want to accommodate the so-called power transition plan,' he said.

Datuk Ahmad Zahid Hamidi, who is contesting a vice-president's post, yesterday agreed with Tan Sri Muhyiddin......

A Kedah Umno leader told The Straits Times: 'In all fairness, what can Mr Abdullah do in the next five months? We want to give him a respectful early exit, but his boys have not accepted this fact.'....... . Some want Abdullah to exit earlier Straits Times

The new MCA leadership has been urged to seriously ask for a second Deputy Prime Minister’s post.

Penang delegate Tan Teik Cheng said the party should conduct serious negotiations with Umno to appoint an MCA leader as second DPM.

"If there is a second Deputy Prime Minister from MCA, he will help to guarantee the benefits and rights of the Chinese community in cabinet and Barisan Nasional," he said.

Selangor delegate Kow Cheong Wei urged that such negotiations be carried out before Deputy Prime Minister Datuk Seri Najib Abdul Razak succeeds Datuk Seri Abdullah Ahmad Badawi.

However, he said such a post should be given with the consent of all component parties and the agreement that they respected MCA as the second largest party and a founding member of the coalition.

"Such a post should only be given if MCA can share the same status with Umno. There is no need for such a post if it has no actual power," he added.

Another Selangor delegate Ng Kok Kiang said such a request must be made to Umno. "We do not want lip service. We want the request to be made and an answer from Umno, otherwise we will become a laughing stock to the Chinese community," he said, adding that MCA should also get a ministerial post related to the economy so that it can help develop the country.

On Friday, newly-elected vice-president Datuk Liow Tiong Lai, speaking as the outgoing MCA Youth chief, proposed the creation of a second deputy chairman's post in Barisan Nasional (BN). Former deputy president Tan Sri Chan Kong Choy also described the proposal as appropriate, timely and not baseless.

In winding up the delegates' debate, newly-elected MCA president Datuk Ong Tee Keat vowed to follow up on calls from the party's central delegates who want the government expedite judicial reforms, review the Internal Security Act (ISA) and revamp its economic policies.

"I assure all (party) members that I will follow up on all the issues raised by the assembly's delegates because that is the mandate given by them to me.

"The delegates are like the cooks. We are the dish they choose. They are the ones to taste it, decide whether it is good or not.

"I agree with my deputy (Datuk Seri Dr Chua Soi Lek)’s analogy that too much belacan added to kangkong will make the dish taste bad. (The combination of Ong and Chua’s surnames Weng Cai sound like kangkong in Chinese).

"But I will do all that is necessary to ensure MCA remains relevant (politically)."

Ong said he will try to accomplish all the reforms listed out in his presidential election manifesto.

On the president’s right to appoint the secretary-general and other posts, especially the vice-presidents, he said it was too early to talk about that.

"It will be decided as soon as the first central committee (CC) meeting is held," he said.

Earlier, in his deputy presidential round-up of the debates, Chua had told the assembly he knows how to play second fiddle.

"Weng Cai (kangkong) is tasty as long as it is not fried with extra belacan as it will become unhealthy," he said, adding that as Ong is a strict leader, he shouldn’t have any problems working with him.

Chua hoped the delegates will not see the role of the deputy president as a blind-follower as "sometimes, we have to agree to disagree".

"The emerging two-party system in the country means MCA must be competitive in tackling national issues instead of focusing only on socio-communal problems.

"Otherwise, we will close shop in the next general election if we fail to reform and change," he said.

Chua said his immediate concern was to work with Ong to formulate a mechanism to fine-tune the party.

How silent everything is. Like watching a motion picture when the sound has failed.

Richs looks up at his mother and smiles. She smiles down at him but I see she is covering her grief. She's very distressed about something but she doesn't want them to see.

And now I see what the glass door is. It is the door of a coffin - mine.

Not a coffin, a sarcophagus. I am in an enormous vault, dead, and they are paying their last respects.

It's kind of them to come and do this. They didn't have to do this. I feel grateful.

Now Richs motions for me to open the glass door of the vault. I see he wants to talk to me. He wants me to tell him, perhaps, what death is like. I feel a desire to do this, to tell him. It was so good of him to come and wave. I will tell him it's not so bad. It's just lonely.

I reach to push the door open but a dark figure in a shadow beside the door motions for me not to touch it. A single finger is raised to lips I cannot see. The dead arent permitted to speak.

But they want me to talk. I'm still needed! Doesn't he see this? There must be some kind of mistake. Doesn't he see that they need me? I plead with the figure that I have to speak to them. The dark figure moves towards me threateningly, but I hear Richs's voice, "Where?" faint and distant. He heard me! And the dark figure, enraged, draws a curtain over the door.

Not the mountain, I think. The mountain is gone. "AT THE BOTTOM OF THE OCEAN!!" I shout.

And now I am standing in the deserted ruins of a city all alone. The ruins are all around me endlessly in every direction and I must walk them alone.

BADAWI: Malaysia's beleaguered leader rebukes critics

Malaysia's embattled prime minister has lashed out at his predecessor, Mahathir Mohamad, and other critics who want him to hasten his retirement.

In a hastily arranged news conference, Prime Minister Abdullah Ahmad Badawi accused Mahathir late yesterday of wanting "to create changes, anger and hatred," the national news agency Bernama reported.

"What right has (Mahathir) to do this?" Abdullah said during a visit to eastern Malaysia. "It's better for (Mahathir) not to speak at all today."

Mahathir, who handed power to Abdullah in 2003, has emerged as the harshest critic of his successor's policies. Mahathir has urged ruling party officials to ensure that Abdullah's associates are removed from key posts in party elections next year.

Abdullah's remarks illustrate the continuing political infighting despite Abdullah's pledge to step down by March to appease dissidents within the ruling coalition.

Who is he? asks Abdullah

The gloves came off yesterday. Prime Minister Datuk Seri Abdullah Ahmad Badawi's patience finally wore off and he lambasted his predecessor, Tun Dr Mahathir Mohamad, and minister Tan Sri Muhyiddin Yassin.
Abdullah said Dr Mahathir was acting as if it was he (Dr Mahathir) who should determine who played what role in the party.

"Who is he ? He has left Umno but he still issues orders to members of Umno. The party does not need to take orders from anyone who is no longer a member of the party," said Abdullah who was here to attend the Hari Malaysia and closing of the Merdeka month celebrations.

"He is trying to create a rift and (incite) anger and hatred. What is wrong with people who work with me? He is trying to teach people to hate one another."

I was reading what Lim Kit Siang wrote in his blog on Eurocopter deal. He mentioned Abdullah, Minister of Defence, SCOMI and Kamaluddin in the article.

Abdullah should be aware that his first act as Defence Minister, announcing that the Defence Ministry has agreed to acquire new helicopters from European helicopter manufacturers, Eurocopter, to replace the Nuri has been immediately dogged by integrity and transparency questions – in particular, the allegation about the involvement of his son Kamaluddin Abdullah in the Eurocopter deal. The Eurocopter Cougar EC725 was one of four aircraft shortlisted by RMAF. The other three were the Sikorsky S92, Agusta Westland EH-101 Merlin and the Russian-made Mil Mi-17 Hip. If no full explanation is forthcoming from Abdullah, I will be raising this issue in Parliament when it reconvenes on October 13. Today, Debra Chong reported in Malaysian Insider that The Public Accounts Committee (PAC) will be conducting inquiries into a number of recent controversial deals involving both the public and private sector, including the acquisition of Bank Internasional Indonesia (BII) by Maybank, the Eurocopter deal and the broadband project awarded to Telekom Malaysia.

If we push the clock back a little bit, on 26th of September 2008, barely 9 days after taking over the Ministry of Defence from Najib, Prime Minister Datuk Seri Abdullah Ahmad Badawi announced the Defence Ministry has agreed to acquire new helicopters from European helicopter manufacturers, Eurocopter, to replace the Nuri, He said the ministry was now scrutinising the clauses in the agreement before signing it officially with the company concerned."I have been told that the Defence Ministry has identified Eurocopter as the replacement for Nuri. 4. Purchasing defence assets has been critised over and over again. It was not too long ago that Anwar while campaigning for Ijok by election pushed Najib to the corner with the accusation of commissions on arm deals. As far as Anwar is concerned we do have to distinguish between the issue and the motive. Observers noted Anwar's strategy in climbing up the greasy pole when Najib is already half way up, and he himself is still blackened with dirts down below. Abdullah has been spared as sacred cow.

When a particular issue is discussed and debated at length and taking the national platform, that in itself is a CASE, regardless of whether there is a real legality behind it all. The openess enjoyed by the opposition since 2003 is not always sweet. Some issues are bitter and full of hatred. None is for the betterment of Malaysian and Malaysia. All are personal. Element of vengeance can be found in most cases especially the one run out of court. When Anwar talked (debated?) for 6 hours in parliment raising doubt on current 2009 budget, Anwar made a mistake by putting pressure on Najib. Abdullah was spared like a sacred cow!

If i zero in into goals of each case, I feel both sad and bad about their ill intention. It is all about scrambling up the greasy ladder of leadership. "The Openess" has been seriously abused. We also have to make a clear distinction between cases mentioned in courts and those on the streets. Some has legal standings where as some are for political gimmicks. Yes, that pole is greasy as you climb and the worst part is it can accomodate only one person.

Malaysian PM backs heir over Mongolia murder case

Malaysia's Prime Minister Abdullah Ahmad Badawi on Monday defended his deputy, who is slated to take power next year, against allegations that he interfered in a high-profile murder case.

"I can't believe that he would be involved in abuse of power," Abdullah told reporters after a political website published an SMS exchange over the case allegedly between deputy prime minister Najib Razak and a lawyer.

"I believe in him that he would be a good person, he would be prime minister and provide leadership," Abdullah added.

Abdullah to Najib: MCA and Gerakan not happy?

Gerakan and MCA we are told, are of the opinion that all BN components should be "involved' and "consulted" on the Abdullah – Najib transition plan. It's only natural that they want in (in the talks ). After all they are friends of UMNO. Their take on the matter must surely worth something if not everything. So they say.

Let people join Barisan directly, says Pak Lah

The Prime Minister has mooted setting up a "new group" in Barisan Nasional to give direct membership to those who wish to participate in Barisan but do not fancy its component parties.

Datuk Seri Abdullah Ahmad Badawi, who is also Barisan chairman, said this multiracial membership would not only make Barisan more inclusive but could be a good beginning for its reforms.

Calling it a possible important reform and new approach, he added that it is for the component parties to deliberate. He had raised the matter at the Barisan supreme council meeting on Oct 8.

Abdullah said several people had told him they supported and wanted to get closer to Barisan but did not want to join any of the component parties.

"But they want to be associated with Barisan and wish to be given an opportunity to talk in a format they think is appropriate and good. They want to interact with Barisan leaders and have been talking a lot about Barisan must do this and that," he said after opening the two-day Gerakan National Delegates Conference on Saturday.

Asked if the set-up would be as a Barisan supporter club or a political party, he said details had to be worked out by Barisan. "I just want to say that it is an opportunity (for the people) to join in a more organised and formal way. What name we are going to call it, I wouldn't know."

On whether this was the first step towards making Barisan a multiracial party, Abdullah said he would not predict what would happen in the future.

"If an experiment like this can exist and do well, I am very happy. Maybe in the future we go on as we are, but we don?t know, we must try," he said and opined that Barisan should provide a platform for these supporters of Barisan.

On whether this move was because the role of Gerakan and People's Progressive Party (PPP) is ineffective, he said it did not mean so and it was up to people's interpretation.

While pointing out that the people decide for themselves whether to join any party, he said the Barisan parties need to open up more.

He also pointed out that the PPP and Gerakan were originally formed to promote multiracialism but today both were dominated and associated with only a certain race."Previously I told (former Gerakan president Datuk Seri Dr Lim) Keng Yaik that there are Malays who may not want to join Umno or even PAS but prefer a multiracial party. I told him to please let them in because at least Gerakan is still Barisan's party."

"But this could not become a reality due to reasons."

Earlier, when mentioning this matter in his opening speech, he said the Gerakan founders? multiracial objective had not been realised today.

"I am not making an accusation, but Koh, it has not been achieved," he told Gerakan president Tan Sri Dr Koh Tsu Koon who was also seated on stage.

Nevertheless, he expressed confidence that Gerakan's plan to go on a membership drive to attract more multiracial members would work. He said even opposition party DAP is not actually multiracial.

Abdullah Badawi specifically list down five things he likes to see through before Mac 2009. Anti Corruption and Special Complaints Commission are two long overdue items. These two could have been executed years ago. Judicial Reforms is special because it emerge out of Lingamgate. Anwar used that as bait. The photographer is in the parliment busy clicking, but some quarters take that seriously and seek reforms. But Zaid has gone!

Social Safety Net and convention are two safe items and nobody will object. Butwhat will Najib think?
