BUNUH ALTANTUYA , ANWAR atau SUHAKAM?

ANWAR BUNUH ALTANTUYA?

Mahfuz  looked like a lawyer.

SUHAKAM: LET ME DIE

MALAYSIAKINI: April: The tale of two hills and the duo

Tale of two hills; Bukit Gantang and Bukit Selambau will be made known in April and so will the fate of UTK duo.

Altantuya murder case:
UTK duo to know their fate on April 9

Police special action squad (UTK) personnel Chief Insp Azilah Hadri and Cpl Sirul Azhar Umar who are charged with murdering Mongolian national Altantuya Shaariibu, will know their fate on April 9.

High court judge Mohd Zaki Md Yasin fixed the date to deliver his decision at the end of defence case, after hearing submissions from both prosecution and defence teams.

(The defence team made their submission on Monday while prosecution submitted on Tuesday)

DPP Manoj Kurup today submitted that the prosecution has proven beyond reasonable doubt the guilt of the two accused, warranting a conviction on the murder charge of murder, in pursuance of a common intention.

"The several strands of circumstantial evidence that the prosecution has painstakingly proved have remained unrebutted, unexplained and unanswered by both accused in this case."

"The combined strength of those strands of evidence when twisted together has formed two ropes, strong enough to hang each accused person," he added.

"The two sets of defence (one by each of the accused) has not only failed to raise any reasonable doubts on the prosecution’s case with respect to the guilt of each accused, (but) it is clear that each accused is trying to blame the other for the murder," said Manoj.

"What is proven beyond peradventure is that both accused took the victim away that fateful night of Oct 19. Now they turn against each other. The fact remains: the victim was never seen alive after that," said Manoj, adding that the two accused made bare denials.

"Azilah submitted a defence of alibi before the trial. (But) Azilah did not dare to call his so-called alibi witnesses and Sirul did not dare to testify under oath," he said.

"Azilah's evidence, for want of a better word, was bare denial at its sublime best," he said, adding taht Azilah claimed that he was not the last person to be with Altantuya on the night of Oct 19.

"In fact, Azilah claimed it was Sirul, who was with Altantuya leaving Bukit Aman on the fateful night, " said Manoj who also submitted that the call logs (telephone communications) showed the movement of Azilah on the night of incident.

He said it showed a logical progression towards the crime scene and back, as was the prosecution’s case all along, and nothing said by Azilah in his defence had cast any doubt on that position.

"What we have is nothing but bare denials of the movements by Azilah from Bukit Aman onwards on the night of Oct 19," said Manoj, adding that the call logs negate not just any probable, but any possible alibi of Azilah.

"Where is the alibi defence of Azilah?," asked Manoj.

"By failing to call alibi witnesses, Azilah lost the chance of casting a reasonable doubt on the prosecution’s case," he added.

Manoj submitted that Azilah's testimony under oath was "littered with inconsistencies, discrepancies and improbabilities" that only one inference is possible from it, that is, "Azilah is spinning a yarn."

He submitted that the finding of Altantuya's jewellery and watch, the presence of the deceased’s DNA on the inside of Sirul’s jacket and the finding of bloodstains on the slippers taken together completely, demolishes Sirul’s statement that he had nothing to do with the murder of the deceased.

He said Sirul had no rational explanation as to how he knew the jewellery and the watch were in his jacket, hanging in the wardrobe of his house.

"He had no rational explanation as to how these items got there in the first place. All he had was the convenient ‘police frame-up’ excuse."

"It is respectfully submitted that not only was there not an iota of evidence suggesting a frame-up, there was also absolutely no reason shown as why the police would want to do something so despicable to one of their own kind," said Manoj, adding that "the defence of the two accused persons, begs questions, but answers none."

POSTERING WITH MALAYSIAKINI: not altantuya again.

I cant imagine PKR is going to use that tactic again, altantuya murder poster!. It is really an old case/issue and to a certain extent the case has been adequately treated by the court. Syed Jaymal posted a news item on the said issue in Malaysiakini. [PKR Youth members arrested in KT from Malaysiakini]

2. Altantuya murder is an ongoing criminal case handled by our own court. It has always been that way for a long long time. The court will handle cases and lawyers will fight it out. In some places a native court/tribunal will come in to solve disputes. Meanwhile everyone just has to keep mum over the issue, otherwise we are seen as meddling. Those with legal minds will say in contempt of court, or simply disrespectful of the court, its process and its invested power.

3. In an earlier post, I mentioned about someone poking at your belly. For the first time, you will jump according to your "geli" resistance. But if the guy keep poking a hundred times over months, you get used to it, your consciousness will take over. You may not even react or at worst, you give the guy a swing at slightest indication.

4. Lets tease our memory for a minute. It was Ijok's by election when PKR used the very same issue to the maximum. Sensible folks were wide eyed, wondering what the hell PKR and Anwar were so happy and jumpy about playing the issue or rather the scandal. Then our wicked mind began to understand the reason why. It is all about Anwar wanting to be the next Prime Minister, and too bad Najib is in the way. Therefore Najib has to be eliminated. But Ijok by election is never Najib's baby.

5. If campaign is very much issue/scandal based, I have to be frank with Anwar and his supporters that they soon will find themselves irrelevant. The worst part is, the same issue has been played far too often ever since Ijok seeked re election. People get bored, and the police get angry and soon everyone will get pissed. A few friends were damn sore, when Bad [the Rembau candidate PRU12] showed his political maturity in testing MACC. MACC to them is fun! Another poke at the belly?

6. Meanwhile Nizar is not too certain what is to become of freeholding of leased lands. A reader had submitted a long article in Utusan Malaysia 5.1.2009, putting historical and legal light into it. I tell you, it will not go down well with those who really understand about land matters and historical attachment. I am not too sure what the fellow folks from Lekir and Pasir Panjang think about it.

5. To be fair lets be respectful to law and regulation. Too much street talk will not do much good to us Malaysian and at worst we are seen as playing and toying with the law. That is not good. It is like driving at 180km/hr and intermittently look back if any patrol car will chase you. One cant be too committed with Jew's saying "everything is fine in chaos" as they bulldozed Ghaza to shambles.

6. Lets read what is Syed hamid Albar reaction to the arrest: 'Five people were arrested and released on police bail,' said Home Minister Syed Hamid Albar, adding that the five were suspected of defamation.

'You can't breach the law. If they spread criminal defamation the police should take action. In a democratic system we should act with responsibility,' he told a press conference. Opposition members arrested Straits Times, Singapore

Razak Baginda on truth, lies and blogs

Maria J.Dass

Three weeks after he was freed of abetment to murder of his Mongolian lover in a long and sensational trial, political analyst Abdul Razak Baginda today broke his silence to hit out at bloggers who turned lies and assumptions into truth, so much so that the truth became irrelevant.

"I was shocked at the extent my case had been wildly exaggerated and that throughout his two years of imprisonment, lies and baseless assumptions have become the basis for truth, so much so the truth had become irrelevant and was lost in translation," he told a packed press conference at Hotel Maya here.

"While some have told me to say nothing, I feel if I do not be brave and try to turn the tide in order to tell the truth, then I will be merely turning a blind eye and allow the liars to prevail."

He said after his release on Oct 31, he gave a statement to the police regarding private investigator P. Balasubramaniam’s first statutory declaration which had implicated Deputy Prime Minister Datuk Seri Najib Abdul Razak.

The investigator, who has gone into hiding, had withdrawn his allegations in a second statutory declaration a day later.

“I told them what I told you all today, that Najib did not know or has met the deceased (Altantuya Shaariibuu)," said Abdul Razak:

“I implore all of you and the public to stop spreading lies about Datuk Seri Najib and his wife Datin Seri Rosmah Mansor as I know they have never met the deceased Altantuya.”

Saying that he had not been in contact with Najib since his release, Abdul Razak described his relationship with Najib as an official one and that he (Najib) was a friend whom he had personal contact with.

Asked about what he thought of Najib becoming the next Prime Minister, he said: “He (Najib) is a well read person and well in tune with what is going on in the world, and in terms of intellectual and experience, he will make a good Prime Minister.”

Asked if he would continue rendering his services as a political analyst to Najib when the latter becomes Prime Minister, Abdul Razak said: “I’m quite happy with my freedom at the moment and don’t want to be tied up with any appointment whatsoever...not that it’s coming.”

Abdul Razak also touched on several other matters:

> On blogs:

People should start questioning the validity of the information they receive, especially from blogs.

We are supposed to be a knowledge-based society and a thinking people but now one or two bloggers form an opinion, and that becomes public opinion.

Bloggers could even be used as tools by enemies of the state to erode confidence. Then we are talking about something more sinister.

Most bloggers write based on hearsay and not based on what they themselves have seen or heard. This is just a phase that develop countries had gone through once and after some time the opinion of bloggers will have little effect.

I expect my statement to be twisted as well. But this is the truth and if anyone wants to twist and turn, then all I can say is that I have said my piece and to me this is the truth. Quoting Shakespeare, he said: “A lie is halfway round the world before the truth has got its boots on.”

> No link between the murder case and the Scorpene and Agosta submarine deal
There are no linkages to this whatsoever. I’m appalled by the extent of lies, but the time frame between the striking of the deal and when I met Altantuya will explain this. The arms deal was signed in June 2002, I met the deceased on Nov 2004; so I fail to see the connection.

> On claims of interference from the top
Referred to SMS exchanges between the first lawyer representing him (Datuk Muhammad Shafee Abdullah) and Najib, he said: “Let me just remind you that I was charged, imprisoned, waited for my trial, court started and went on for 151 days, I was separated from my family, I went through all that! So how can there be any interference if I went through all that, God Almighty! Come on!”

> On public reaction to his release
To my surprise a lot of people came up to me and wished me the best- total strangers- came to say that they were happy that I had been released. I was pleasantly surprised because I thought I was going to be frowned upon, going to be a leper, that everyone will shy away from me.

> What next?
I will be going to the United Kingdom (UK) to complete my doctorate studies. I’m going back to UK for a simple reason. Not many of you know this. I was a student at Oxford and on Sept 28, 2006, two weeks before I got arrested, I submitted a doctoral dissertation to Oxford having studied at Trinity College Oxford for a number of years.

The university put my dissertation on hold and now that I have been released, I have been informed by the university that I can be examined, so I’m now going back to be examined- and Insya Allah – I can get my doctorate by early next year. I am not running away. I wil be back, unless I can land myself a cushy job like prime minister over there.

> On his ordeal
It is difficult for anyone to understand what I have gone through. When you are down you are basically alone, this is a lesson to me and I managed to get through this with the support of my family and God.

He attributed his several outbursts in court to frustrations over the delays in the trial and issues that he had to go through.

It was the most stressful, anxious and sad period of my life. The 22 months I spent in jail gave me a chance to reflect on life.

It is perhaps human nature that when someone is in trouble, people shy away. Prior to my imprisonment, during the Hari Raya season, I would receive hundreds of cards but for the last two years I received a total of not more than 20.

My family, my close friends, my lawyers and my books have all added to my escape, for my mind was never incarcerated. To me this was my ‘great escape'.

The prison authorities demonstrated a high degree of professionalism and I thank my fellow inmates for their kindness.

> On his relationship with Altantuya
The person has died; let the person rest in peace. I would like to emphasise that I did not commit any offence in respect of the deceased, nevertheless I would like to express my deepest sympathies to the family of the deceased for their loss.

RAZAK BAGINDA: Saved by his affidavit

Saved by his affidavit

Abdul Razak's tell-all document before trial, detailing key events, turns out to be an astute move

By Carolyn Hong, Malaysia Bureau Chief

Kuala Lumpur - The acquittal of political analyst Abdul Razak Baginda in the high-profile murder case of his former Mongolian lover made big headlines in Malaysian newspapers yesterday, with many zooming in on how his affidavit had saved him.

The sleazy and sensational affair, and Mr Abdul Razak's close ties to Deputy Prime Minister Najib Razak, had kept the case in the public eye as the trial ran for two years.

His almost-forgotten affidavit filed two years ago was the highlight as it was pivotal to the High Court judge's decision to acquit him of abetting the murder.

The document was filed in court in an attempt by Mr Abdul Razak, 48, to obtain bail before the trial started. He failed to get bail and there was criticism then by legal experts who considered it a wrong move to disclose his case so early in the trial.

But it turned out to be an astute move. High Court judge Mohamed Zaki Mohamed Yasin on Friday ruled that the tell-all affidavit had helped clear him of the charge of asking two policemen to kill Ms Altantuya Shaariibuu.

'In the absence of the rebuttal evidence against them (statements in the affidavit), coupled with the fact that there is no legal onus for him to rebut any statutory presumption, there is clearly no reason for the statements to be ignored and rejected,' the judge said.

The lengthy document detailed how Mr Abdul Razak met Ms Altantuya in 2004, and had an affair with her that lasted until 2005.

After they broke up, he alleged that the 28-year-old interpreter harassed him, and that he had sought the help of the police. But he denied telling them to kill her.

According to court evidence, Ms Altantuya's remains were found in a jungle outside Kuala Lumpur, blown up with explosives after she was shot dead.

The judge found that 13 statements in the affidavit were not rebutted by evidence put forward by prosecutors. In a nutshell, they recounted how Mr Abdul Razak had asked Mr Musa Safri, a security aide of the deputy premier, for help because of Ms Altantuya's harassment.

Mr Musa reportedly said he would introduce him to a police officer. The co-accused Azilah Hadri, an officer from an elite unit that guards VVIPs, called Mr Abdul Razak the next day.

Mr Abdul Razak said he called Azilah on Oct 19, 2006, when Ms Altantuya turned up at his house.

Ms Altantuya was taken away by three police officers. Mr Abdul Razak said he subsequently asked Mr Musa what had happened to Ms Altantuya but the aide said Azilah did not tell him.

The judge on Friday found these statements were corroborated by witnesses at the trial, and 'clearly negated and nullified the act of abetment as alleged'.

This detailed legal explanation was, however, described by veteran opposition politician Lim Kit Siang as a technical one, as he demanded further investigation.

The immediate public reaction on the Internet was, as expected, similar. Mr Abdul Razak's close ties to DPM Najib were hauled out to hint at favoured treatment although there was no evidence of this.

Mr Lim wrote in his blog that it was imperative for Mr Najib to face an independent government inquiry on the allegations.

So far, Mr Abdul Razak has not given his side of the story. After his acquittal, he went back to his house in upmarket Damansara Heights before going to the mosque for Friday prayers.

He wore broad smiles each time he came out of the house, but declined to speak to reporters. He was quoted by The Star daily as saying he would speak to the press only this week.

He also said he had been fasting for the 22 months since he was arrested.

His two co-accused, Azilah and Sirul Azhar Umar, who allegedly killed Ms Altantuya, have been ordered to present their defence. The hearing will begin on Nov 10.

Malaysian PM backs heir over Mongolia murder case

Malaysia's Prime Minister Abdullah Ahmad Badawi on Monday defended his deputy, who is slated to take power next year, against allegations that he interfered in a high-profile murder case.

"I can't believe that he would be involved in abuse of power," Abdullah told reporters after a political website published an SMS exchange over the case allegedly between deputy prime minister Najib Razak and a lawyer.

"I believe in him that he would be a good person, he would be prime minister and provide leadership," Abdullah added.

The ghost is running wild in Malaysiakini and Malaysia Today

BERITADARIGUNUNG

It is like the title of another ghost story or filem seram or cerita seram of Mastika. Ghost has been there with us, seldom seen but very much felt and feared.

Mastika used to be a sought after digest for students decades ago. There were alot of academic essays then, but now Mastika is different. Too heavy on cerita seram dan sensasi.

Malaysiakini find it necessary to post an interesting highlight from an article in Malaysia Today, Altantuya-Najib allegations resurface on Oct 12, 2008.

She was dead and Razak Baginda and two others had been in court for months to ascertain who kill her. Shall we let the court to sit and conclude? For all we know, Razak Baginda is very cool throughout the court hearings, but he lost his cool once as reported by crankshafted here. I highlighted this in one of my earlier posting .

Yes, the ghost is running wild but not all about seeking the truth. Some quarters put on their x-ray visors trying hard on a witch hunting trip. Regular kopitiam friends likened the issue as yet another battle cry of starvation in Baling.

Shall we let the ghosts have some peace, as what we had done on Canny Ong and Najib's case. It would probably be best to go on with life on the present tense. Some incidents are best left behind even though some of us are eager to ressurrect the grand old days of Anwar.

To Anwar, RIP means Rest in Peace. Bersemadi. Let us live in the present tense and pave the way for a brighter future.

Umno Youth to counter slander against leaders

2008/07/05

KUALA LUMPUR: Umno Youth will counter every accusation against party leaders by Datuk Seri Anwar Ibrahim, its chief Datuk Seri Hishammuddin Hussein said.

In a statement yesterday, Hishammuddin said Umno had had enough of Anwar's "lies, accusations and nonsense" and would not stand idly by as he slandered party president Datuk Seri Abdullah Ahmad Badawi and deputy Datuk Seri Najib Razak."Anwar's accusations against our leaders are to divert attention from the new sodomy allegations against him."We will mobilise our members all over Malaysia to meet the public, we will explain and rebut every accusation by Anwar and prove that it is nothing but a bunch of lies."On Thursday, Anwar endorsed a statutory declaration by Razak Baginda's former private investigator, P. Balasubramaniam, linking Najib with murdered Mongolian Altantuya Shaariibuu.

Yesterday, however, Balasubramaniam retracted his sworn statement, saying that it was made under duress."The withdrawal of the sworn statement proves that it was all just a big lie concocted by Anwar. "It also shows that Anwar is good at playing dirty politics," Hishammuddin said.

Joining Hishammuddin in the attack on Anwar was Putera Umno chairman Datuk Abdul Azeez Abdul Rahim, who accused Anwar of attempting to settle his latest sodomy allegations through a trial by media.

"If Anwar is indeed innocent of sodomy then let him prove it in court. He shouldn't shift the spotlight off himself by hurling baseless and hurtful accusations at our national leaders through the media," Abdul Azeez said."I support Perak Mufti Dr Mohd Asri Zainul Abidin's suggestion that we settle this sodomy allegation in an Islamic fashion."Let Anwar and Mohd Saiful Bukhari Azlan (his accuser) both appear at Masjid Negara, swear on the Quran and tell the truth."

Anwar: the connections in Imran's view.

Imran said...
Najib had explained that Saiful came to his office three months ago to get a support letter. The photo with Najib's aides was taken then. I am more inclined to think that Saiful is planted to tarnish Najib more than Anwar.

I don’t believe the allegation against anwar as much as I don't believe the other allegations and slanders running wild from both sides. We have seen the very systematic and professional strategy employed to slander Najib and his wife. I guess Najib’s long experience in politics has prevented him from making mistakes such as using his position to shut the witnesses’ mouth, unlike Anwar back in the 1990s. The use of C4 is just a strategy to link Najib with the Altantuya's murder.

I don’t believe that this episode is BN’s engineering for the reason that the BN are very well aware of how damaging the 1998-1999 experience had been and to be using the same trick is plainly committing harakiri.

The accusation against Anwar is probably meant to slander the BN more than Anwar. We could already see that many Malaysians are quick to point fingers at BN, particularly Najib, the real political target.

I believe Saiful is a player of a conspiracy to damage BN. It is puzzling that pictures of him with Najib’s assistant, Azlina, Dato’ Mustapha could be produced in lightening speed, or as someone had claimed, to be already published by bloggers or Saiful himself several months ago. What more, it’s already in Wan Azizah’s phone. I would not be surprised if Saiful, in the next few days, weeks or months, admitted that he had falsify the allegation under duress, insinuating Najib's involvement with the crime.

The allegation is a strategy to trigger a domino effect that could push the country into another anarchic like episode, similar to what we saw in 1997-1999: the world economy plunging; similar accusation leveled against Anwar; the BN leader's refusal to step down; BN breaking up and; opposition gaining momentum.

The question is what are the end points?
(1) Destroy BN for good. The 1997-1999 episode had weakened BN tremendously. Another uprising will deliver the final blow that would destroy BN for good.
(2) Unite the oppositions who are clearly cracking up, and to deviate attention from the repeated blunders committed by PR government.
(3) Pushing oppositions into government
(4) Pushing the country into anarchy
(5) The final endpoint is to destroy Islam in Malaysia, being the only country where Muslims are progressive

Based on the tract record of BN, I am not really against other political parties taking over the government. However, the current PR pack, set up in a haste, and which appeared intent to gain leadership in an undemocratic ways, would not be my ideal government in waiting. Particularly, when their supposedly representative of Islam, PAS, aside from some rhetorics from Pemuda PAS, had badly failed to represent the voice of Islam.

In conclusion
(1) I don’t believe the sodomy allegations against Anwar back in the 1990s as much as I do not believe that they were staged by Mahathir. I believe both Anwar and Mahathir were victims of the puppet master. It was unfortunate that Mahathir had fallen into the puppet master's trap by committing one mistake from another.
(2) I don’t believe the recent sodomy allegation against Anwar and I also don’t believe the allegation was engineered by BN. If BN had wanted to slander Anwar, for sure they would plant some other low profile individuals, rather than Saiful who's photos taken with BN officials are of no secret, being published in some blog since the last few months.
(3) I don't believe the allegations against Najib and his wife. It is unfortunate that Anwar and Wan Azizah had taken used the issue to support them politicallyWho is/are then the puppet master? Think!
