Hindraf leader being treated in Malaysian hospital

Everybody seems to get their share. Hindraf get their fair share in media coverage since day one. Anwar, a Cherok Tok Kun guy catapulted his stature as leader of all races even higher. MIC somehow being marginalised through this wicked political coup. It was a sad phenomena.

Like or not, issues on Indians are best handled through MIC. Hindraf yelled, Anwar shouted and everybody paraded, still it is going to be MIC to do the donkey job. MIC will scrutinise and list the issue and work it out through the government arm, I think.

I dont know if Uttayakumar is made in the mould of Irish Bobby Sands, born in Rathcoole North Belfast in 1954. Has he got the stamina to go the distance to the graveyard.?

Hindraf leader being treated in Malaysian hospital

Prominent ethnic Indian leader P Uttayakumar, currently detained under Malaysia's tough security law, is being treated for his illness at a government hospital, a top minister has said.

Human Resources Minister Dr S Subramaniam said he had been informed by the Home Minister Syed Hamid Albar that Hindu Rights Action Force (HINDRAF) leader Uttayakumar, a diabetic, had been receiving treatment at the Teluk Intan government Hospital.

Subramaniam said he hoped that the government would make arrangements if Uthayakumar need specialist treatment for his diabetes-afflicted foot.

His remarks came after Uthayakumar's supporters alleged that their leader is being treated improperly and they filed police complaint in this regard.

Police used water cannon to disperse about 200 of them near the Brickfields police station here last Saturday. Uttayakumar and four of his Hindraf colleagues have been detained under Internal Security Act since December 2007 for organising an illegal rally of ethnic Indians on November 25, 2007, which was attended by more than 20,000 members of the minority community to protest against alleged marginalisation of ethnic Indians in jobs and opportunities.

The government of Malaysia has denied the allegations.

HINDRAF: the ghost of SINN FEIN?

So they are fighting the so called draconian ISA by being hungry. What is the connection between being hungry and protest against ISA? I wish to share and starve with Malaysiakini on this element, the much debated matlamat halalkan cara.

The hunger strike, which will last five days, is to protest against the draconian ISA and to demand all detainees be freed.

2. Lets rewind the clock a little bit. Sometime in 1981, a person by the name Bobby Sand went all out on hunger strike. That hunger strike clinged on an interesting thing, almost similar to this Hindraf, between a person in jail and a person in power. It was between Bobby Sand and Margaret tatcher.

3. Bobby was elected as Member of Parliament while in jail, thus creating a world wide interest as the hunger strike escalate. Ten prisoners died including bobby himself. Then politics in Great Britain was greatly radicalised pushing the emergence of Sinn Fein.

4. What is to become of our little Hindraf? A protest over ISA? But when Hindraf sprang into action as prelude to PRU12, their aims were somewhat different. Of course pragmatism allows changes as one proceed on, looking for the best option within a particular situation. Hindraf has shown his/her eagerness in politics time and time again, and of course the platform is PRU13.

5. In some countries, there is a law to handle suicide [The deliberate taking of one's own life.] . Under Common Law, suicide, or the intentional taking of one's own life, was a felony that was punished by Forfeiture of all the goods and chattels of the offender. Under modern U.S. law, suicide is no longer a crime. Some states, however, classify attempted suicide as a criminal act, but prosecutions are rare, especially when the offender is terminally ill. I see dead leaves everyday, a few days after they turn yellow.

Hindraf adrift one year after mass protest

By Baradan Kuppusamy

Last night's gatherings in Batu Caves and a Penang temple to mark the anniversary of last year's explosive Hindraf protest were tame affairs with low turnouts, in what is a clear sign the movement's influence is waning amid a police crackdown.

Members of Hindu Rights Action Force (Hindraf) hold banners as they shout slogans after prayers to commemorate the first anniversary of the Nov. 25, 2007 mass rally at a Hindu temple in Kuala Lumpur, yesterday. — AP pic

The recent spate of arrests of prominent Hindraf leaders and the constant warnings by police not to stage any further protests may have also deterred Hindraf followers from filling up the streets once again to mark the 1st anniversary of the Great Awakening, as the Nov 25 protest is now known.

But more significantly, the lack of a clear and firm leadership is probably the most major setback for the movement.

Top Hindraf leaders led by lawyer P. Uthayakumar and four others are now incarcerated in Kamunting and out of the picture.

Another founding leader P. Waythamoorthy is in self imposed exile in London and unable to effectively manage the movement.

In the meantime the Hindraf leadership has been taken over by various "co-coordinators" whose allegiances are increasingly in question. There is frequent infighting among the coordinators.

Despite the setbacks there is strong public support for Hindraf but the support is uncoordinated, and not gathered into a coherent political movement to win resources for the Tamil working class from the political centre.

The DAP's and PKR's Indian leaders remain keen to tap on to the Makkal Sakthi or people's power of the Tamil masses for their political careers and as a result they dominated the two commemorative functions here and in Penang.

At the Sri Maha Mariamman Temple in Batu Caves about 500 Hindraf supporters attended a prayer ceremony and climbed the 272 steps to light oil lamps and chant "Makkal Sakti Valga" (long live people's power).

In Penang about 700 people prayed at the Sri Maha Mariamman temple in Butterworth to commemorate Nov 25. They were led by Penang Deputy Chief Minister P. Ramasamy and coordinator R.S Thanenthiran.

Ramasamy promised to declare Nov 25 a national public holiday if Pakatan Rakyat captured the federal government.

He added that he would ask the PR- ruled Penang to declare a state holiday on Nov 25.

It is unclear how a holiday would advance the Hindraf cause or put bread on the table and cash in the pockets of the Tamil working class but the offer is emotive and would endear the opposition to the Hindraf supporters.

On this day in 2007 nearly 30,000 Indians marched to the capital to demonstrate and demand an end to marginalization and equal treatment and a fair share of the national wealth.

Despite greater political representation their demands remain largely unrealized although there appears to be greater sensitivity - both in the opposition and the government - to the needs of the Tamil masses.

The vast majority of Indians live in the Pakatan Rakyat ruled states of Selangor, Perak, Penang and Kedah and the state governments have come under great pressure to deliver.

On the side of the BN government a cabinet committee under deputy Prime Minister Datuk Seri Najib Tun Razak has been formed to comprehensively review the problems Indians face and how to resolve them.

Hindraf supporters who expected immediate change in their lives after voting for the PR parties are now growing increasingly frustrated at what they see as a "failure" by the PR governments to satisfy their needs.

But they are not yet disillusioned enough with PR to again embrace the BN though that day may not be far off going by the lukewarm reception to the Hindraf call to show protests yesterday.

Both PR and BN will continue to pay lip service and make cosmetic changes to exploit the Hindraf movement for political gains.

But this indeterminate situation could change dramatically if the founder and leading light of Hindraf P. Uthayakumar is freed and allowed to lead the movement again.

6-year-old 'protester' walks free

KUALA LUMPUR: A six-year-old girl and her mother, a supporter of the outlawed Hindu Rights Action Force (Hindraf), left a police station yesterday after spending a night there.

But 10 other activists they were with when police took them away on Thursday will be remanded till tomorrow.

Mrs K. Shanti and her daughter P. Vwaishhnnavi, together with the 10 activists, had tried to submit a letter to the Prime Minister's Office in Putrajaya. They were asking for the release of Hindraf's five leaders, detained under the Internal Security Act, ahead of Deepavali next week.

The letter was rejected by Prime Minister Abdullah Badawi's office. The Malaysian government banned Hindraf two weeks ago, declaring it an extremist group.

Kuala Lumpur police chief Muhammad Sabtu Osman later told news website Malaysiakini that the girl had not been arrested. She and her mother were released late on Thursday night but opted to stay on with the rest of the activists, according to the New Straits Times.

The girl's uncle, P. Uthayakumar, is one of the detainees while her father, Hindraf chairman K Waythamoorthy, had earlier fled to London to escape arrest.

The girl has been a familiar face at Hindraf's protests. On Thursday, she was seen toting a poster that said 'Release Our Leaders'.

Police Watch Malaysia coordinator S. Jayathas, one of the 10 arrested, claimed that the group was taken away after being told that they formed an illegal assembly.

'We were trying to obtain permission from the security guards for Vwaishhnnavi to submit her letter. They said that we were from Hindraf, but we insisted that we were 'concerned Indians' ...accompanying Vwaishhnnavi,' he said.

Yesterday morning, the 10 activists were taken to the Kajang magistrate court. Security was tight - police barred journalists and supporters from entering the building, allowing in only family members and the lawyers of those arrested.

According to lawyer N. Surendran, the activists are being investigated for participating in an unlawful organisation. The New Straits Times also said that Mrs Shanti is being investigated for child abuse.

Hindraf Can't Solve Community Problems

Hindraf Can't Solve Community Problems

THE growing voice of ethnic Indians indicates the complexity of their social problems. Most of the grievances merit attention but they should be addressed within the law and must not provoke racial hostility, writes MOHD SALLEH ISMAIL.

Hindraf comprises 30 Hindu non-governmental organisations (NGOs). It came to the spotlight when its leaders took the startling action of filing a suit against the British Government at the Royal Courts of Justice.

It sued the British government for bringing Indian workers into Malaysia as indentured labour without ensuring that after independence the Federal Constitution provided adequate protection for their rights.

The lengthy document it presented to the British Court focused on the failure of the Reid Commission to clearly define freedom of worship and religion in a multiracial society, to consider the employment of Indians in the Malayan Civil Service, and to "formulate effective economic policies to uplift the socioeconomic position of the minority Indians".

As a result of these omissions, "all 523 Tamil schools in Malaysia have not been made fully-aided government schools with equal and same facilities granted to national schools"; Indian children did not enjoy "equal opportunities for higher education", and Indians were disadvantaged in business ventures and in appointments to senior positions in the public sector.

These discriminations, the legal document asserted, had condemned the Indians in Malaysia to an inferior position.

It is undeniable that the Indians in Malaysia, though initially mainly working as hard labour in the plantations and in road and rail construction, helped lay a solid foundation for the country's economy, especially in infrastructural development and the rubber and oil palm industries.

Similar grievances have also been voiced by ethnic Chinese citizens since independence.

One major Chinese complaint concerns the New Economic Policy. The goal of NEP is to eliminate racial bias through poverty eradication and social restructuring, but deviations in implementation made them suffer discrimination and deprived them of development opportunities.

They complain that the government seeks to achieve social restructuring through discriminatory quotas against Chinese in higher education, professional and vocational training, employment and job promotion.

They point out that in poverty eradication, resources are being mainly channelled towards raising incomes and productivity in rural areas predominantly inhabited by other ethnic groups, while the urban poor Chinese have been largely neglected.

Some observers have been tempted to link the fortunes of ethnic Chinese and Indians to China and India. Some allege that the overseas Chinese were the "Fifth Column" of the People's Republic of China engaged in infiltration, subversion and armed insurrection to overthrow the governments of their countries of residence.

This is inevitable on two counts.

HINDRAF: the hard truth emerging

Hindraf declared illegal

The Hindu Rights Actions Force (Hindraf) has been declared an illegal organisation from today, said Home Minister Datuk Seri Syed Hamid Albar.

In a statement issued here, Syed Hamid said the decision to declare Hindraf as an illegal organisation was made following the ministry being satisfied with facts and evidence that showed Hindraf had and was being used for unlawful purposes and posed a threat to public order and morality.

“Based on powers vested under Section 5(1) of the Societies Act, Hindraf from today is declared an illegal organisation,” he said.

He said the order was being made as a result of monitoring and investigation on the organisation’s activities by the Registrar of Societies (ROs) and Home Ministry, since Hindraf’s inception.

Syed Hamid said if left unchecked, Hindraf would continue to pose a threat to public order, the security and sovereignty of the country as well as the prevailing racial harmony.

“The decision to declare Hindraf an illegal organisation is not based on one or two of its activities that are in contravention of the law but covers all the actions it has taken since being formed,” he said.

Syed Hamid said Hindraf had all the criteria of an organised movement because it had filed for registration with the ROS on Oct 16 last year.

The application had yet to be approved but Hindraf had actively exploited the Indian community to organise illegal assemblies and street demonstrations without permits to the point of causing a segment of the community to rise up against the Government and also hatred among the Malays and Indians in the country, he said.

“Hindraf has also tried to secure support from foreign countries for the purpose of pressuring the Government to bow to its demands,” he added.

Syed Hamid advised the public to distance themselves from Hindraf and not participate in any way in any of its activities. - Bernama

HINDRAF : the issue and comical truth.

By Helen Ang

An alert should go out to embassies in Kuala Lumpur cautioning foreign nationals. The updated travel advisory:

(1) Open houses in Malaysia are possibly illegal,
(2) If a tourist should saunter into the premises, he may be guilty of trespassing,
(3) A tour group could be banned by Malaysian authorities for unbecoming behaviour, such as all its members wearing uniform attire,
(4) Cops on duty at open houses will confiscate a greeting card and such other contraband, as well as
(5) Summon to police headquarters for questioning if someone attended open house but rejected refreshments, did not shake hands with the VIP host and failed to extend festive wishes.

Meanwhile, locals are expected to behave in exchange for free lunch at the Putra World Trade Centre. The Star reported Tourism Minister Azalina Othman warning that some Malaysians at open houses give a poor reflection of the country’s image to tourists. “If you are here as a guest, then behave as one. Parliament will convene on Oct 13. They can do so (submit their memorandum) then,” she said.

Azalina was referring to Hindraf supporters but Hindraf legal advisor N. Surendran has countered there was no memorandum delivered. Memo or no, Prime Minister Abdullah Ahmad Badawi, his deputy Najib Razak and Home Minister Syed Hamid Albar still complained the Indians were ‘kurang ajar’ (untutored), ‘biadab’ (unmannered) and ‘tak beradab’ (uncivilised).

The badmouthing is a clear example of one group, Umnoputeras, demonising another group of fellow citizens. Visitors should also be aware that they cannot believe all they read in Tourism Malaysia brochures about the country’s ‘racial harmony’, and in the mainstream media (MSM) about BN’s successful formula of ‘national unity’.

Yes sir, Umno sir

Deputy Home Minister Wan Ahmad Farid Wan Salleh has intimated that there are many options on action against Hindraf for causing – I’m borrowing the following description from the Star’s headline – a ‘commotion at the government’s Raya open house’, and otherwise being ‘aggressive’, ‘unruly’, ‘provocative’ etc, etc, as alleged by some Malay associations. Home Ministry secretary-general Abdul Aziz Mohd Yusof is looking into banning Hindraf. Information Minister Ahmad Shabery Cheek called on all political parties to condemn the incident.

What did Hindraf do that was so bad to make Umno big shots so angry?

A six-year-old girl wished to give the PM a teddy bear and Raya card. She is the daughter of Hindraf chairman P. Waythamoorthy and brought the bear in a basket along with some flowers. She had wanted to give roses too last year to Abdullah, who refused to receive her on Valentine’s Day.

This is a little girl who has been separated from daddy for almost one year now as Moorthy is likely to be ISA-ed if he ventures to step foot on Malaysian soil. This is the small child who must be wondering whatever her Uncle Kumar did wrong that caused the authorities to lock him up, under ISA.

And this is the gist of Abdullah’s complaint: “The rest (of their words), which I heard very clearly, was, ‘Abolish the ISA! Free the Hindraf! Abolish the ISA! Free the Hindraf!’ That’s all they wanted to tell me. This is not the spirit of Hari Raya, where you wish (Selamat) Hari Raya, are happy and have fun and socialise.”

How does an unwelcome guest answer when quizzed by police on why he fails to socialise and display the requisite joyfulness at the PM’s party? Lawyer Haris Ibrahim who blogs ‘The People’s Parliament’ wrote that he and his Hartal ISA group (wearing solidarity-with-RPK T-shirts) were ushered by police to a holding room and segregated.

People’s Parliament last November launched a ‘Hartal MSM’ campaign in the wake of newspapers disinforming on Bersih and demonising Hindraf. MSM has not changed its slant against the Indians. The Star article on the alleged commotion during Raya carried the byline of four reporters. If a whole quartet covered the story, surely one of them could have obtained Hindraf’s clarification that the movement did not present any memo. But no.

Instead, the popular rag – which incongruously dubs itself ‘the People’s Paper – preferred to give airing to VIPs as per its usual practice of cue journalism. The Star report had quoted Azalina and also Unity, Culture, Arts and Heritage Minister Mohd Shafie Apdal admonishing, “Hindraf members should have known their limits and not turn up at an open house ‘like this’.”

Star’s article had Shafie going: “There are platforms for you to make your submission. This is not the proper way of doing things. I mean, it’s a Raya do. Today is Hari Raya, it’s got nothing to do with memorandums.”

The spirit of Raya

The Star, a publication under the control of MCA, is big on ‘the proper way of doing things’. It has been full of how the Chinese communal party always used ‘proper channels’ and engaged in ‘internal discussions’ with BN (though not quite admitting that the outcome of any discussion is MCA invariably kowtowing to Umno).

But not only did that particular Star article omit Hindraf’s clarification that there was no memo, it also failed to mention that Indians throughout the past year had made many attempts to convey the community’s grievances to the powers-that-be and were ignored. So the ‘the proper way of doing things’ gets nothing done.

The paper similarly neglected to publish that unlike MCA Cabinet ministers who engage in closed door sessions where they ultimately accede to ‘the BN consensus’ (read, again kowtowing to Umno) Hindraf pleaded they had no other opportunities to approach the PM except at the open house.

BN’s idea of propriety and legality is ‘do as I say, not do as I do’. Abdullah, who often preaches Hadhari, sermonised on religious tolerance around Merdeka last year when at the same time, Hindu temples were tumbling down around him. His big ears did not hear government bulldozers destroying the houses of worship.

To the PM, the spirit of Raya is that everyone must be happy, have fun and socialise, unlike the Hindraf crowd creating “a lot of unhappiness to a lot of people who were around” at his PWTC, possibly illegal, gathering.

Since I’m not Muslim, it’s hardly in my place to contradict the Grand Imam of Hadhari. I’ll just note that when I balik kampung to Penang, I saw many billboards put up by the Pakatan state government bearing its Ramadan message of ‘Amar makruf, nahi mungkar’ (Do good, abhor evil and sin).

Does amar makruf not accommodate compassion for a discriminated community, and courtesy to women and children who were in the Hindraf delegation?

Umno and its collaborators instigating Malays to view Hindraf as bogeyman threatening Malay rights is amar makruf? Malaysiakini reported Surendran as saying Hindraf has become the victim of a harsh campaign to incite hatred against the movement and Indians.

Moorthy and many others in Hindraf agree, and have filed police reports but may have to wait for investigations to be completed first on insulting (Case 1) egg and (Case 2) PWTC food which the bloggers and Hindraf refused to touch.

We’ve often lamented ‘between the devil and the deep blue sea’ to signify BN, the devil we know, and the uncharted waters of the Opposition. A few months ago, Justice Ian Chin described Dr Mahathir Mohamed as “a devil incarnate” and Dr M hitting back at the judge, gestured with his hands at a pair on imaginary horns on his head.

Although the Malay word ‘ampu bodek’ has infinitely more oomph, the English translation ‘polishing apples’ largely characterises MSM coverage of domestic politics and BN politicians, First Families and their in-laws. But a metaphor of polishing the devil’s horns is a more apt on the nature of our mass media’s collusion with the establishment in demonising Hindraf.

Dilemma of Indians and Keadilan Party: A SIMPLE OBSERVATION

BERITADARIGUNUNG

death 1

In 2000, then Kedah state assemblyman for Lunas, Dr Joe Fernandez while talking on his mobile phone was shot dead in Bukit Mertajam by unidentified men. Dr. Joe Fernandez, 54, who was shot three times by two men at the Jalan Maju Jalan Harapan junction in Bukit Mertajam on a motorcycle while driving home from his clinic in Kulim on Nov. 5, 2000. He was shot at his abdomen. He died at the Bukit Mertajam Specialist Centre at 3 pm.

According to the police, the politician, who was also Kedah Malaysian Indian Congress (MIC) deputy chief, was caught in a traffic jam at a junction in Bukit Mertajam about 2.30 pm. Two men on a motorbike stopped beside his Nissan Terrano and one pulled out a gun. At that time, the doctor was on his mobile phone with an employee at his clinic nearby.

After the shooting, the gunman walked back to his waiting accomplice and drove off, leaving bystanders dazed. Dr Fernandez's employee rushed to the scene on hearing the gunshots over the phone. He drove the doctor to the specialist centre. But it was too late and Dr Fernandez died half an hour later.

"This is certainly not a robbery,'' said Penang deputy chief police officer Datuk Abu Kassim Md Noor. Police also ruled out the possibility of the involvement of hired killers as there had been no reports of death threats to Dr Fernandez. The police have yet to confirm the motive for the killing and described it as cold-blooded murder.
Datuk Abu Kassim confirmed that the police had a description of the suspects and were investigating.

The politician leaves behind his wife, Dr Louis Mary Rose, and a daughter. After joining the MIC in 1975, he was elected as Kedah MIC Youth chief four years later and retained the position until 1990. He won the Lunas state assembly seat in 1995 and defended it successfully against three challengers in 1999 general election with 9760 votes against M Kathiravelo (DAP) 5060 and Ibrahim H Md Rashdi (Bebas) 2168.

Coincidentally, the late Dr Joe was replaced by none other than Saifuddin Nasution of Keadilan. To most observers, strong linkage between Keadilan and Indian community has never been so strong. We shall not probe deeper for fear of being prejudiced.

In the Lunas by election, Saifuddin Nasution Ismail of the Keadilan party took the Lunas seat by a wafer-thin majority of 530 votes beating an MIC candidate. However There were accusations of racism when the Keadilan party refused to field an ethnic Indian candidate and selected a Malay.

death 2

S. KrishnasamyTenggaroh Assemblyman was assassinated on January 12, 2008 when a gunman shot him dead at 2.30pm just as Krishnasamy arrived at the party headquarters in Johor for a committee meeting. It is believed that the shot hit below his left eyebrow. The bullet went through to the back of his head. He had received death threats weeks before he was murdered.

Krishnasamy, 61, who was also the Johor MIC deputy chairman, was shot dead in the lift of the Johor MIC headquarters. He was found slumped in a pool of blood in the lift at about 2.10pm by Johor MIC Puteri chief R. Vithiya Mohan.

MIC president Datuk Seri S. Samy Vellu said Krishnasamy had told him about the threats before he left for India two weeks earlier.

“I just advised him to take care. That was the most I could say,” he said, adding that such threats were not unusual in politics. However, he could not confirm if the threats were linked to politics or business.

Prime Minister Datuk Seri Abdullah Ahmad Badawi has expressed shock over the murder of Tenggaroh State Assemblyman Datuk S. Krishnasamy in Johor Baharu, and described it as a cruel and despicable act.

Eight months later, September 2008, A 38-year-old businessman was detained in connection with the murder, Johor CID chief SAC II Amer Awal said . The 38-year-old businessman, who owns a restaurant business in the city, was picked up at about 9.15pm late Thursday. His arrest comes within days after the 36-year-old son of a senior MIC politician was picked up in connection with the murder. The arrest was made by a team from Bukit Aman.

It is learnt that investigations so far point to “politics” as the likely motive behind the killing. Dozens have been picked up in connection with the case, but all have since been released.

Murukasvary (MIC) later won the Tenggaroh seat in the general election PR12 after securing 11789 against PAS candidate Shahar Abdullah who just managed 3556 votes.

Hindraf

PKR de facto leader Anwar Ibrahim said "I support HINDRAF's right to peaceful demonstration and therefore reiterate my appeal to the Royal Malaysian Police to approve a permit for their rally to take place on 25 November 2007." click here.

Anwar has described the Hindraf rally at the British High Commission as “a safety valve for long smoldering Indian Malaysian grievances.”

Anwar Ibrahim said he had been invited to attend some conferences on democracy in India and that he had only raised genuine grievances faced by minority groups in Malaysia during his current lectures.

"These conferences were planned five months ago, I gave my commitment and I attended," he told Bernama when asked what made him come to India at this time.
"The lectures were about the state of democracy and I gave my honest answers."

This is the famous Hindraf Memorandum to UK Prime Minister.

Dear Sirs,

RE: 1. COMMONWEALTH ETHNIC INDIAN PEACE LOVING SUBJECTS IN MALAYSIA PERSECUTED BY GOVERNMENT BACKED ISLAMIC EXTREMIST VIOLENT ARMED TERRORIST WHO LAUNCHED A PRE DAWN VIOLENT ARMED ATTACK AND DESTROYED THE KG JAWA MARIAMAN HINDU TEMPLE AT 4.00 A.M THIS MORNING (15.11.2007).

2. APPEAL FOR U.K TO MOVE EMERGENCY U.N RESOLUTION CONDEMNING “ETHNIC CLEANSING” IN MALAYSIA.

3. APPEAL TO REFER MALAYSIA TO THE WORLD COURT AND INTERNATIONAL CRIMINAL COURT FOR CRIMES AGAINST IT’S OWN ETHNIC MINORITY INDIANS.

We refer to the above critical matters in Malaysia but which generally gets the least attention locally even by the Opposition parties, NGO’s, the Malaysian Human Rights Commission and the media for this community is generally regarded as politically insignificant, do not draw local or international funding and are deemed not pressworthy. To the contrary the Malaysian government has successfully projected itself to the world as a modern Islamic thinking country which is not true.

The ethnic minority Indians in Malaysia were brought in to Malaysia by the British some 200 over years ago. Since independence in 1957 the Malaysian Indians have been permanently colonialised by the Islamic fundamentalist and Malay chauvinists UMNO led Malaysian government.

Among the recent atrocities committed by this government are as follows:-

1.100 over Indians were slashed and killed by the UMNO controlled Malaysian government in the Kampung Medan mini genocide. Despite numerous appeals, the Malaysian Human Rights Commission has refused to hold a Public Inquiry. The UMNO controlled Malaysian courts struck off a victim’s public interest civil suit for a Public Inquiry to be held without even the said UMNO controlled government having to file in their defence. The UMNO controlled Attorney General and the Inspector General of Police refused to investigate and / or initiate an inquest into the death of at least six Indians in this tragedy despite.

2. Every week one person at average is killed in a shot to kill policy and in every 2 weeks one person is killed in police custody. About 60% of these victims are Indians though they form only 8% of the Malaysian population.

3. In every three weeks one Hindu temple is demolished in Malaysia.

The latest being the demolishment of the Mariaman temple in Padang Jawa, Shah Alam, Selangor early this morning (15.11.2007) and the next being the (Mutaiya) Hindu temple in Sungai Petani scheduled for the 29.11.2007.

A violent armed pre down attack at 4.00a.m this morning was launched by the UMNO controlled Malaysian government backed by about 600 police, riot police, Islamic extremist and armed terrorists which completely destroyed this temple.

In an attack two weeks ago, uniformed police, riot police and city Council officers hurled rocks and attacked unarmed Hindu devotees with knives, sticks and iron rods.

At least 20 Hindu devotees were seriously injured and 19 arrested including 4 of their United Kingdom trained lawyers in direct violation of Article 5 (Right to life) Article 8 (Equality) Article 11 (Freedom of Religion) Section 295 (defiling a place of worship), Section 296 (disturbing a religious assembly), 298A(causing racial disharmony) and Section 441(criminal trespass) of the Malaysian Penal Code.

These authorities are plagued by an above the law mindset and in fact liberally take the law into their own hands. These atrocities however does not happen to almost all Islamic places of worship. Please visit www.policewatchmalaysia.com for further and better particulars.

4. State sponsored direct discrimination against the Indians in Public University intakes, Indian (Tamil) Schools, skills training institutes, civil service and private sector job opportunities, business and license opportunities and in almost all other aspects of daily life.

Despite our hundreds of letters, appeals and pleas to the Malaysian King and Sultans, the Prime Minister, Attorney General, Inspector General of Police, Ministers, Chief Ministers and the latest being our letters to the Prime Minister dated 29.10.2007 and 30.10.2007 and to the Attorney General dated 1.11.2007 the Malaysian authorities are only proceeding with greater ferocity and with impunity with very little regard for the Federal Constitution and laws of Malaysia. So please help us.

CONCLUSION

We fear that this peace loving Indian community of Tamil origin having been pushed to the corner and the persecution getting worse by the day may be forced to into terrorism in a matter of time as what has happened to the Sri Lankan Tamils.

APPEAL

On our part we are committed to a peaceful and lawful struggle and pray and appeal that the Government of the United Kingdom:-

1. Moves an emergency United Nations resolution condemning these state sponsored atrocities and persecutions of Malaysian Indians in Malaysia.

2. Refers Malaysia to the World Court and the International Criminal Court for Crimes against it’s own ethnic minority Indians

Thank You,

Yours Faithfully

Legal Adviser

After the rally, a few were detained by police.

Bersih Rally

Coincidentally, another equally important rally took place on the streets in the capital city of Kuala Lumpur on the 10th of November 2007, two weeks before Hindraf Rally. It was seen by many as being far too obvious to be mistaken as coincidence. Some argued further that both rallies were preludes to the General Election of April 2008.

Event organizers of 2007 Rally intended to have a peaceful, non-violent rally, advising participants in the days and weeks beforehand how to keep the rally peaceful. However the rally was marred by government sanctioned police violence. The aim of this walk was to campaign for electoral reform. It was precipitated by allegations of corruption and discrepancies in the Malaysian election system that heavily favor the ruling political party, Barisan Nasional, which has been in power since Malaysia achieved its independence in 1957.

Anwar since 1970's had been involved in street rallies and Bersih rally was nothing new. It was commented by some that, in rallies, people tend to forget about the purpose of the rally, in the heat, enthusiasm and intimedation of the procession. Most will go home feeling angrier. In cunning political atrategy, this is what most politicians want.

Remarks

As a conclusion, now I miss the true meaning of being racist. I am not too sure now, the virtue of playing soft or hard on racial issues in politics. There are far too many people being guilty without being charged. Without doubt there bound to be one or two oppurtunist who emerged as champion while scrambling up the greasy pole of power. Greed and sickening ambitions drive some to racial crazy. As always, ordinary folks will fall as victims in racial disharmony.

Hindraf steps up attack on Mahathir

KUALA LUMPUR: Malaysia's long-serving ruler Mahathir Mohamad destroyed the future of the Indian community by ignoring their welfare, a group claiming to speak for ethnic Indians has said.

Mahathir was "responsible for the plight of Indians in Malaysia", Hindu Rights Action Force (Hindraf) national coordinator R Thanenthiran told the Tamil newspaper Makkal Osai.

He told the media that Hindraf would not have been formed if equal opportunities had been given to ethnic Indians, The Star newspaper quoted him as saying.

Hindraf has been attacking Mahathir after the latter posted on his blog, chedet.com, comments last week that claimed that the indigenous Malays were victims of the political arrangement post-independence when they had to accommodate ethnic minorities with full rights and privileges.

Hindraf has been highlighting perceived discrimination in jobs and education of ethnic Indians, a bulk of them Tamil Hindus. Click here:

Candlelight vigil held for Malaysian Hindraf detainees

Kuala Lumpur, June 8 (IANS)

Family members and friends of those detained under Malaysia's Internal Security Act (ISA), which includes five Hindu Rights Action Force (Hindraf) activists, staged a peaceful candlelight vigil outside the Kamunting detention camp in Perak state.

Among the estimated 80 detainees are Hindraf leaders - M. Manoharan, 46, P. Uthayakumar, 46, V. Ganabatirau, 34, R. Kengadharan, 40, and K. Vasantha Kumar, 34 - who were placed under a two-year detention after they staged a protest rally last November.

The large group was allowed to stage their protest for 15 minutes under the watch of Federal Reserve Unit police personnel during the gathering organised by the "Abolish ISA Movement" Saturday evening, The Star newspaper reported Sunday.

Of the five, Manoharan is a member of the state assembly, elected on the nomination of the opposition Democratic Action Party (DAP).

Perak is an opposition-ruled state and its senior executive councillor (minister) Ngeh Koo Ham was present to monitor the situation.

Ngeh, who is also state DAP chairman, said the state government's stand was that every person had a universal right to a fair trial in a court of law, as opposed to unlawful detention.
The government of Prime Minister Abdullah Ahmad Badawi has fended off appeals for the release of the Hindraf leaders from both the ruling and the opposition parties and human rights bodies.

The government says the Hindraf leaders were trying to disturb the ethnic balance in Malaysia that has majority Malays, about 33 percent Chinese and eight percent Indians.
Malaysia's royal head of the state has confirmed the detention of the five and has ordered that they complete their two-year terms.

The Hindraf is fighting for the freedom of the five leaders in law courts with the support of DAP chairman Karpal Singh, who is of Indian origin.
