Selangor Water is about control and politics

THE Selangor state government has received the backing of trade unions and consumers in its plan to take over the water services industry in the state.

The Malaysian Trades Union Congress (MTUC) and the Coalition Against Water Privatisation presented a joint memorandum to Mentri Besar Tan Sri Abdul Khalid Ibrahim to voice their dissatisfaction over the Federal Government's move to acquire water assets in the state yesterday.

MTUC president Syed Shahir Syed Mohamud said at parliament lobby yesterday he was heartened by the assurances given by the state government that water tariffs would remain at an affordable rate even after the restructuring of the water services.

Under the initial restructuring plan, the state government, via state-controlled Kumpulan Darul Ehsan Bhd (KDEB), would take over the water concessions and assets, to be handed over to Pengurusan Aset Air Bhd, a wholly-owned company under the Ministry of Finance.

The assets would then be leased back to KDEB as the sole licensed operator. This is because after the restructuring exercise, there would no longer be concessionaires.
Instead, licence will be issued to the operator which would be reviewed by the Federal Government every few years.

SELANGOR WITH MALAYSIAKINI: Syabas says NO

Selangor state is damn rich. Therefore state government flashed billions of RM to entice Syabas. Yes, Syabas rejected the first move. I rather keep mum especially after the fiasco of Cows for Car! But Khalid's boys came out stronger with takeover seduction.

Eh, water is free as it fall leisurely from the sky, but once processing and packaging is completed it costs billions. Oh, water is posted through pipes! By the way, countries had gone to war to settle issues relating to water control. Not here, Africa .....

AS anticipated, the Selangor water concessionaires have rejected the state government’s offer to buy over water assets in the state for some RM6bil.

Puncak Niaga Holdings Bhd and Gamuda Bhd issued separate statements to Bursa Malaysia yesterday to say that the offer is lower than they hoped.

Even state-controlled Kumpulan Perangsang Selangor Bhd (KPS) told the stock exchange its 55% controlled Konsortium Abass Sdn Bhd (Abass) has rejected the state’s offer.

KPS directors abstained from deliberating and making decisions on the matter in view of the state government’s interest in Kumpulan Darul Ehsan Bhd (KDEB), which owns 60% in KPS.

Gamuda says its 40% unit Syarikat Pengeluar Air Sungai Selangor Sdn Bhd (Splash) “hoped the state would revert with a more reasonable offer and is prepared to re-negotiate towards achieving a package that is fairer to all parties.”

Puncak, meanwhile, says the offer is “unclear” on whether the state wants to acquire the company or assets of the company.

Under the initial restructuring plan, the Selangor government, via KDEB, would consolidate the concessions, after which it would hand over the water assets to Pengurusan Aset Air Bhd (PAAB), a wholly-owned unit of Minister of Finance Inc

The assets would then be leased back to KDEB as the sole concessionaire.

The Energy, Water and Communications Ministry had ordered the restructuring to be completed by end March.

Earlier this week, PAAB was reported to have “moved in” to negotiate directly with the water concessionaires in Selangor.

It is believed that PAAB’s offer to take over the state’s water assets could be as high as RM9bil. “We think that if PAAB indicates that it would extend a better offer which takes care of liabilities too, the concessionaires would say no to the state and go for federal-owned PAAB’s offer instead,” CIMB Research said on Thursday.

An official from the Water Review Panel of the Selangor government said yesterday that the state will be “more than agreeable” to a direct takeover of the assets by the Federal government if “they can negotiate a lower acquisition price that what we have offered to the concessionaires”.

To queries from StarBizWeek, she says: “Should the Federal government, however, decide to offer a price which is detrimental to the interests of consumers, while unjustifiably ‘compensating’ the concessionaires, the state will certainly object to the takeover. At the moment, we are not looking at tarriffs.”

“The Selangor government is steadfast in its position to safeguard the interests of the public against the private vested interests of the concessionaires,” she says.

Should the state government fail to hand over the water assets to PAAB by end-March, consumers could end up paying water tariff that is 37% higher.

Puncak Niaga was offered RM3.1bil for its water assets and operations as well as those of its 70% subsidiary Syabas without assuming any liabilities.

Gamuda unit Splash was offered RM2.1bil without liabilities while KPS’ Abass was offered RM525.7mil.

“The asset value of RM1.14bil offered by the Selangor government is far below the RM2.2bil invested by Puncak to build and refurbish the water treatment plants under Puncak’s concessions,” Puncak says in its Bursa filing.

“The equity value of RM543.05mil offered is far below Puncak’s shareholder funds of RM1.07bil as at Dec 31, 2007,” it adds.

It says the offer price for Syabas is also insufficient to settle all its (Syabas) borrowings totalling about RM3.3bil and other liabilities.

Selangor Mentri Besar Tan Sri Khalid Ibrahim told StarBizWeek in December that the state government had assessed the water assets in Selangor and “knows precisely the value of each of them”.

“The state believes that by valuing water assets based on future cash flow (which is what the companies are asking for) would not be fair because it intends to keep water rates as low as possible,” an analyst says.

CRISIS WITH MALAYSIAKINI: so, Selangor is on full alert mode

I was less observant lately,

therefore my recent trip to Teluk Intan via Sungai Buloh and Kuala Selangor was without sensitivity of the surroundings.

2. I formed mental capture as the car meandered along the winding road months ago. There was a worship place jutting out into the road. The yellow lines for wakil rakyat parking lot were of different color tone. There were lot of signboards "boleh buang tanah di sini" and a few was on "jangan buang tanah di sini". I understood the message. For others who had dealings with Sime Darby or Golden Hope before, soil or earth is measured in thousand of hectares. Earth in lorry loads is little and has no bearing to their sensitivity.

3. Delivery is the key word in good governance. Some soul searching has to be carried out by any responsible state government, Selangor included. Maintenance bills on private car are just little nuisance easily brushed aside, but being fair, keeping up with promises and good delivery are more urgent and important.

4. So when Khalid Ibrahim said he would be meeting all the state's Member of Parliament and assemblymen Thursday, he is putting Selangor on a full alert mode. Afterall the grins as Anwar put PKR jacket on Nasarudin was short lived, therefore lets not go on offensive. Lets turn to the few remaining pages of Anwar's "Art of War".

SELANGOR WITH MALAYSIAKINI: No crossovers yet


Someone
in our kopitiam morning routine suggested an explanation. Nasarudin temporary exit to PKR was a political gambit. His defection then allowed PKR, PAS, DAP to rejoice. I thought Anwar was smiling happily as he put PKR jacket on Nasarudin. There was another photo in media about Nizar holding Nasarudin's hand and raised for everyone to see. A heroic moment for both Nizar and Anwar.

2. Now that was political gambit. Anwar had shown to the whole world that he was playing defections as a political strategy and in fact he intends to be the next Prime Minister that way, through the backdoor. A kopitiam friend likes this backdoor things and he always correct everyone by saying backside la, bukan backdoor. We know he was joking. But someone else are not joking, they are damn serious!

3. At that momment, another defection should be considered as given. Then Najib announced the names of 3 ADUNs of Behrang, Jelapang and Changkat Jering. Meanwhile Nasarudin felt that he should return. The 3 ADUNs are not defectors in Anwar's mould and thinking. 2 man and 1 woman lost faith in their former political camp. Thats all. Nasarudin is afterall just a political gambit. A bait. Satu umpan. A political seducer of Anwar's calibre failed on his own turf and game!

4. Now is Selangor's turn. Another political gambit? Could Klang issue swallow MPs and ADUNs down the stomach. Can Anwar or Khalid stomach it?

Selangor Menteri Besar Tan Sri Abdul Khalid Ibrahim is sure that no Pakatan Rakyat assemblymen in the state will jump ship following the actions of their counterparts in Perak.

He said the three parties under Pakatan Rakyat — Parti Keadilan Rakyat (PKR), Pas and DAP — understood that crossing over would only bring very bad implications to the parties and the alliance.

“I believe it (Selangor Pakatan Rakyat assemblymen crossing over) will not happen and the likelihood for it to happen is very small.

“PKR, Pas and DAP now understand how we must guard the dignity of our members and parties so that no assemblymen can hop here and there and bring very bad implications to the parties and Pakatan Rakyat as what happened in Perak,” he said at his official residence here today.

He was responding to a question how loyal were Pakatan Rakyat assemblymen in Selangor to the alliance since the collapse of its government in Perak after three representatives — Hee Yit Foong (DAP-Jelapang), Jamaluddin Mohd Radzi (PKR-Behrang) and Mohd Osman Jailu (PKR-Changkat Jering) — left their parties and pledged support for Barisan Nasional (BN) and Bota assemblyman Datuk Nasarudin Hashim redefected to Umno.
BN has taken over the Perak government with the swearing-in of Pangkor assemblyman Datuk Dr Zambry Abdul Kadir as the new Menteri Besar yesterday.

Asked what he would do if Pakatan Rakyat assemblymen in Selangor switched to the other side, Khalid said: “I think there are no signs this will happen.” On Thursday, former Selangor Menteri Besar Datuk Seri Dr Mohamad Khir Toyo said that so far, no Pakatan Rakyat assemblymen in the state had met him to join BN so that the coalition could return to power.

Presently, Pakatan Rakyat has 36 seats in the 56-seat State Legislative Assembly while BN the rest.

In ALOR SETAR, Kedah Menteri Besar Datuk Seri Azizan Abdul Razak said he was sure that it would be difficult to shake Pakatan Rakyat’s majority in his state.

He said today’s government was elected by the people; and as long as the people want him to lead, he would continue to look after their wellbeing regardless of race.

He said the Pas-PKR-DAP alliance government had over the past 11 months brought changes that one can be proud of.

“There are no problems between the assemblymen and the executive councillors that would lead to party hopping.

“I am confident they will not jump because they are my assemblymen and I have to believe in them and so far, government business is running smoothly,” he said. — BERNAMA
