Rejected – bid to amend charge against Raja Petra

PETALING JAYA: A bid by the prosecution to amend the sedition charge against Malaysia Today editor Raja Petra Raja Kamarudin was denied by Sessions Court judge Rozina Ayob.

“The court accepts the objection raised by the defence team. Therefore, the application by the prosecution to amend the charge is rejected,” she ruled yesterday.

Lead prosecutor Deputy Public Prosecutor Ishak Mohd Yusof had earlier tendered an amended charge against Raja Petra.

DPP Ishak said the amendment was to include the website address and title of the alleged seditious article in the appendix attached to the original charge.

Defence counsel Gobind Singh Deo objected to the amendment, saying that the application was not in line with the provisions of Section 158 of the Criminal Procedure Code.

“The prosecution now realises that it has no case under the original charge,” he argued on the sixth day of the sedition trial.

Gobind Singh stressed that five witnesses had testified and the defence had questioned them based on the original charge.

DPP Ishak said the prosecution only intended to add two ingredients in the appendix so that it would be consistent with the sedition charge against the former ISA detainee.

The court later allowed a request by the prosecution to call Cyber Security Malaysia senior digital forensic analyst S. Sivanathan, 28, and the police’s computer forensic investigator ASP Wa’ie Isqal Kria Abdullah, 38, to testify yesterday.

Sivanathan, the sixth witness, told DPP Farhan Read that Raja Petra was listed as one of the profile names in the computer which was used to access Malaysia Today with administrator privilege.

ASP Wa’ie told DPP Ishak that inves­tigating officer DSP Mahfuz Abdul Majid gave him computers for analysis on May 2. He said DSP Mahfuz asked him to search for the seditious article and other files.

“I found several documents in both computers,” ASP Wa’ie said.

The hearing continues today.

Blogger 'detained for two years'

Malaysia's leading blogger has been ordered to spend two years in detention under internal security laws after being accused of insulting Islam, his wife says.

Raja Petra Kamaruddin, a prominent government critic and founder of the Malaysia Today website, has been sent to the Kamunting detention centre in northern Perak state on the order of the home minister, Marina Lee Abdullah told AFP.

US concerned over Malaysian use of internal security act

WASHINGTON (AFP) - The government of US President George W. Bush views with "grave concern" Malaysia's use of its tough Internal Security Act (ISA) as a possible way to stifle dissent, the State Department said Thursday.

Washington worries about "the possibility" that the act, which allows indefinite detention without trial, "might be used again to detain opposition political figures," said spokesman Sean McCormack.

"The statement by a government figure that a leading member of the opposition had become 'a threat to the economy and national security' is extremely troubling," said McCormack, referring to warnings by Prime Minister Abdullah Ahmad Badawi against opposition leader Anwar Ibrahim, who on Thursday called for a no-confidence vote against Abdullah.

Last Friday Malaysian police arrested Teresa Kok of the opposition Democratic Action Party (DAP), Malaysia's top blogger Raja Petra Kamaruddin, and a reporter with a Chinese-language newspaper under the security law, citing security concerns.

"The United States firmly believes that national security laws, such as the ISA, must not be used to curtail or inhibit the exercise of universal democratic liberties or the peaceful expression of political views," McCormack said.

"The detention of opposition leaders under the ISA would be viewed by the United States and the international community as a fundamental infringement of democratic rights and values," he added.

Dalam nada puitis, rembulan sembunyi dibalik awan adalah halwa telinga. Malang sekali untuk tahun 2008 ini, Malaysia tidak ada masa untuk puisi. Keadaan negara jadi sedikit kelamkabut untuk sesiapa bersantai, terlentuk dan melayan hati dengan puisi. Terpaksalah rakyat jadi pemerhati kepada insiden-insiden yang berat, mendebarkan, dan pada masa yang sama dipaksa memikul tanggungjawab ke atas kenaikan harga minyak. Ini adalah realiti.

Ketika Abdullah membuka negara ini dengan "keterbukaannya", ada pula yang lari lintang pukang bersembunyi. Sebahagian dari cerita bersembunyi kekal sebagai cerita, selebihnya adalah real dan jadi berita.

1. Lebihkurang 60,000 rakyat terengganu menunggu dari pintu masuk bangunan lapangan terbang sehingga ke kem Askar Melayu Di Raja Seberang Takir,
bagi menunjukkan sokongan kepada Yang DiPertuan Agong dalam kes penderhakaan UMNO terhadap Sultan Terengganu selepas PRU12. Dalam krisis perlantikan Menteri Besar Terengganu, rakyat keluar beramai-ramai menyatakan sokongan dan taat setia kepada Raja mereka. Berkumandanglah laungan "Daulat Tuanku" di Terengganu. Sementara itu Idris Jusoh dan Rasool (yang dianggap oleh sesetengah pemerhati sebagai Penderhaka) tidak kelihatan dan dikatakan bersembunyi atau menghilangkan diri.

Pada 28 Jun baru-baru ini, Saiful Bukhari Azlan membuat laporan polis mengatakan Dato Seri Anwar Ibrahim, Penasihat Parti Keadilan Rakyat, telah meliwatnya beberapa kali. Anwar yang menghadapi tuduhan liwat kali kedua dalam karier politiknya dikatakan mendapat perlindungan di Kedutaan Besar Turki, di ibu kota. Keesukannya Presiden PKR, Datin Seri Azizah berkata suaminya terpaksa "bersembunyi" setelah menerima ugutan seminggu lepas.

Azizah juga berkata beliau berunding dengan peguamnya mengenai keperluan mendapatkan suaka politik untuk Anwar.


3. Raja Petra Kamarudin pula telah memaparkan laporan perubatan oleh Dr Mohamad Osman Abdul Hamid daripada Hospital Puspawari, dalam laman siber. Pendedahan tersebut mendapat reaksi pelbagai dari lapisan masyarakat Malaysia. Dimaklumkan bahawa Saiful telah terlebih dahulu berjumpa dengan Dr Mohamad Osman sebelum ke Hospital Kuala Lumpur berkaitan dengan aduan liwat. Kini dimaklumkan Doktor berkenaan telah menghilangkan diri bersama ahli keluarganya. Ada pula yang berkata mereka bersembunyi.


4. Parti Keadilan Rakyat menolak kabar angin Zulkifli Noordin Ahli Parlimen Kulim yang menyertai demonstrasi membantah forum umum Majlis Peguam, sengaja diarah menghilangkan diri bagi mengelak beliau menjadi isu menjelang pilihanraya kecil Permatang Pauh. Ada laporan mengatakan Zulkifli bersembunyi dan berada dalam keadaan selamat bersama orang yang dikenali dan beliau sihat.

Dalam kemelut aftermath forum itu, Zaid dinanti-nanti untuk muncul dan memberi komen kerana majlis peguam adalah dalam bidang portfolio beliau. beliau juga dikatakan bersembunyi dan mengunci mulut. Keadaan itu ketara berbeza dengan langkah "membersihkan" Tun Abbas Saleh sebelumnya.


5. Datuk Bakri Zinin pula telah memaklumkan Interpol dan negara-negara jiran berkaitan kehilangan Balasubramaniam. Tidak berapa lama selepas itu, polis mengesahkan Bala sudah dikesan bersembunyi disebuah negara dan berada dalam keadaan selamat. Bala telah menggemparkan Malaysia bila mengemukakan 2 Pernyataan Bersumpah yang kontradiktori berturut hari.

6. Presiden PAS, Dato Seri Hadi Awang tidak lagi bersembunyi bila menegaskan akan keluar Pakatan Rakyat jika Islam dipinggirkan oleh Kerajaan Pakatan Rakyat yang bakal ditubuhkan pada 16hb September ini. Sinar Harian pula melaporkan PAS mahu Dato Seri Abdul Hadi Awang jadi Perdana Menteri jika Pakatan Rakyat merampas kerajaan dari Barisan Nasional.

Raja Petra ordered to reveal source and reader IDs

KUALA LUMPUR: A High Court here has ordered Malaysia Today editor Raja Petra Kamarudin to reveal his sources for the allegations he made against lawyer Datuk Muhammad Shafee Abdullah in three online articles.

In addition, the wide-ranging order compels him to, within three days of its service to him, reveal the identities of visitors to his web portal who had left comments and messages following the articles.

In the three articles dated Aug 6, Aug 7 and Aug 11, Raja Petra had accused Shafee of masterminding the recent sodomy charge against PKR de facto leader Datuk Seri Anwar Ibrahim.

The order, granted by Justice Tee Ah Sing in chambers, also included several injunctions, the first of which directs Raja Petra to remove the defamatory articles from the web portal within two days as well as to remove any other follow up articles and comments posted by visitors.

Injunctions were also granted to restrain him or his agents from further publishing the said articles or any other articles, journals, letters, comments, posts and statements that are defamatory of Shafee on the web portal or any third party websites.

The order was the result of an ex parte summons in chambers filed by the lawyer, who had earlier Wednesday filed a defamation suit against the blogger over the same articles.

The court fixed Sept 2 to hear the inter partes application.

When contacted, Shafee said the order granted by the High Court was against "a blog owner who continuously, maliciously and contumeliously went on a rampage to defame me."

"I have not seen anything more defamatory than what this man has written. None of what he said is true," he said.

Shafee also challenged Raja Petra to enter appearance in this case and dared him to prove the truth of the contents of all three articles.

As at press time, the three articles were still available on the Malaysia Today portal.

Abdullah denies getting report on Altantuya case

Wednesday June 25, 2008 KUALA LUMPUR: Prime Minister Datuk Seri Abdullah Ahmad Badawi has refuted an allegation that he had received a written report from military intelligence over the murder of Mongolian Altantuya Shaariibuu.

“Of course I am concerned (over the allegation by Malaysia Today blogger Raja Petra Kamarudin). What Raja Petra did is unacceptable ... because what he stated is incorrect.

“It is stated (in Raja Petra’s statutory declaration) that I received a report from the military intelligence. That is not correct,” he said yesterday.

Abdullah said this when asked to comment on the statutory declaration made by Raja Petra on June 18 in which he stated, among others, that Abdullah had received a written report from military intelligence on Altantuya's murder. – Bernama

Instead, Raja Petra Kamaruddin is out on bail battling a sedition case.

Just before the 8 Mar elections in Malaysia, Raja Petra was approached by the Democratic Action Party (DAP). "They offered to put me up in a safe seat," the fiery Malaysian blogger told The New Paper on Sunday in an exclusive interview.

The DAP went on to win 18 seats in the Perak assembly, yet not one of the winners was a Malay Muslim.

The state's constitution has it that only a Malay Muslim can be the menteri besar. This resulted in a Parti Islam SeMalaysia (PAS) nominee becoming the menteri besar.

Why did Raja Petra decline the offer?

"I would have lost my freedom. In fact, if I had taken up the offer, I wouldn't be able to sit down here talking to you this freely. I am happy as of now," said the 58-year-old editor of Malaysia Today, sitting outside a café in Kuala Lumpur's upmarket Bangsar Village.

Freedom to speak his mind, like allegedly implying that the Malaysian Deputy Prime Minister Najib Razak was involved in the killing of Altantuya Shaariibuu, a 28-year-old Mongolian interpreter.

3 DAYS IN JAIL

It was that allegation which saw him being charged with sedition on 6 May. He spent three days in jail, before being bailed out by Marina Abdullah, his wife.

He was held in solitary confinement in a cell that measured about 1.5 m by 2.5 m, with a squat toilet and a tap.

The Sungei Buloh prison had other bigger cells, some of which housed 80 to 100 prisoners. "The whole place was smelly," he said.

Raja Petra suffered severe back pain while in jail. He had to sleep on the floor, on a ½ inch foam mattress, which did not help his back.

He alleged that prison officials did not want him to be taken to the prison hospital because Abdul Razak Baginda was there.

Abdul Razak, a political analyst and friend of Mr Najib, is on trial for abetting the killing of Altantuya.

"The prison officials told me that they did not want me to meet Abdul Razak. So they asked me to tell my wife to take me out by posting bail," he said.

The blogger had refused to seek bail initially and even refused food. He said his refusal to seek bail was to "make it into a people versus government issue and not Petra versus government".

That was why he sought to raise money for bail by appealing to his readers – just RM1

(42 cents) per person.

So far more than RM70,000 has been collected. It has been put in a trust, to be used to bail out any blogger or writer who is arrested by the government.

He was also threatened while in jail. He said the two police officers, accused in the killing of Altantuya shouted at him while he was being brought in. Was he worried?

"No," he said. Threats have become part of life to him. Over the years, he has received several threatening phone calls. Some have even called him a traitor to the Malay race.

Raja Petra is a member of the Selangor royal family. He is a nephew of the late Sultan Salahuddin Abdul Aziz Shah, who later became king.

Raja Petra, whose mother was Welsh, could easily pass off as a tourist in Bangsar Village. But while his wife sipped her latte and he narrated his experiences to me, several people who passed by waved or wished the couple. It was clear that the two are popular visitors to the area.

His eyes lit up when he was asked to compare former prime minister Dr Mahathir Mohammad, Prime Minister Abdullah Badawi and opposition leader Anwar Ibrahim.

"Dr Mahathir is an adventurist. He took risks. But he does not listen to others.

"He is a good commander – strong, but a lot of people have to make sacrifices for that," he said.

He pointed to Dr Mahathir's adventurist streak in building structures like the Petronas twin towers, which were then the world's tallest, and other mega projects.

Mr Abdullah, according to him, has "no strengths... But he is willing to listen.

"However, he does not make any decisions. He is just the opposite of Dr Mahathir."

So who would make a good leader for Malaysia?

"A little bit of Dr Mahathir and a little bit of Mr Abdullah, would be excellent," was his view.

When asked whether Mr Anwar fit that bill, his answer was that even though the Keadilan leader had both qualities, he has a problem.

STRONG-MINDED

"Mr Anwar is strong-minded like Dr Mahathir. He listens to others. He is prepared to say he is wrong.

"But the problem with him is that after he has made up his mind, he changes it if someone tells him something and again changes it if another group approaches him. He goes by what the last person tells him. This can create friction."

Our discussion gradually veered round to the ruling Umno. If Mr Najib fails to succeed Mr Abdullah, what were the chances of Umno vice-president and trade minister Muhyiddin Yassin?

"On his own, his chances are slim but if he teams up with former finance minister Tengku Razaleigh Hamzah, then their chances brighten.

"Ideally, Mr Muhyiddin should aim to be the deputy of Mr Razaleigh and take over after one term," he said.

Does the fall of Umno and Barisan Nasional in the eyes of the Malaysian people mean the aspirations of newly-elected MP Khairy Jamaluddin, the son-in-law of the Malaysian PM, are over?

Raja Petra wouldn't buy that argument. "Khairy is smart. He is not finished. He has a good future. He made the mistake of trying to cut the queue. He has to learn to work his way up. He has opportunities. Malays being feudalistic helps his chances."

Followers of Malaysian politics keenly watch Raja Petra's website. He is known to come up with explosive stories of Malaysian politicians which others fail to report. Has he anything significant up his sleeve which is due to appear soon on his website?

"A lot of things. But certain things cannot be revealed." That was all what he would say.

He is willing to stop his blog if the present government is ousted and Malaysia gets a two-party system. But he has conditions.

The ruling party should have only 55 per cent of the seats with the opposition taking the rest. There should be an independent judiciary and and an independent commission against corruption with powers to prosecute.

If these materialise, he will give up Malaysia Today and "drive all over Europe". Something which he has done before – once on a bike and then in a van with his wife and two other couples. Those days, he said, were his most memorable ones.

PETALING JAYA: Malaysia Today editor Raja Petra Kamaruddin was released on bail at 9.30am Friday.

His wife, Marina Lee Abdullah, posted bail of RM5,000 on Thursday after her husband agreed to it.

Raja Petra had declined to meet visitors, including his wife, since Tuesday, when he was taken to Sungai Buloh prison after refusing to post bail.

Marina finally managed to persuade her husband on Thursday.

Speaking to reporters after he was released, Raja Petra said he had declined to meet anyone as there was not much to be done except await his trial, which is scheduled for October.

However, prison authorities urged him to seek release due to concerns over his personal safety in prison, he claimed.

Raja Petra also said he had not eaten anything since he was taken to prison on Tuesday.

Malaysian blogger starts hunger strike in jail

A Malaysian blogger in jail after writing an article allegedly linking a top leader to the gruesome killing of a Mongolian woman has begun a hunger strike, his wife said today.

Raja Petra Kamaruddin, founder and editor of the popular Malaysia Today site, has been charged with sedition for allegedly implicating Deputy Prime Minister Najib Razak and his wife in the October 2006 murder.

He refused to post bail set at 5,000 ringgit ($A1,685.27), opting instead to be locked up until his trial begins on October 6.

"He is on a hunger strike. It is a protest, he is not guilty and he is being punished," his distraught wife, Marina Lee Abdullah told AFP. . here .

Malaysian Special Branch

The Special Branch or SB (Malay: Cawangan Khas) is an intelligence agency attached to the Royal Malaysian Police. The SB is empowered to acquire and develop intelligence on internal and external threats to the nation, subversive activities, extremist activities and activities of sabotage and spying. It is also empowered to analyse and advise on the necessary course of action to the various departments and agencies both within the Police Department and other related agencies.

The SB was initially modelled after the Special Branch of the United Kingdom. The current departments within the SB are [1]:

Activities

Communist insurgency (1948-1989)

During the Malayan Emergency, when the Malayan Communist Party (MCP) guerillas were in open revolt, the Special Branch successfully infiltrated the party chain of command. Reportedly, one Special Branch officer managed to gain sufficient trust from the MCP to be ordered to infiltrate the Special Branch. He in turn managed to feed false information back to the MCP. It has also been claimed that the second-most high-ranking official in the MCP was a Special Branch agent, who was executed when he was discovered. [2]

The Special Branch's activities during the Emergency were widely praised, garnering accolades such as one calling it "one of the finest establishments of its kind in the world". Other intelligence agencies sent observers to a Special Branch training centre in the Malayan capital of Kuala Lumpur to learn its tactics of infiltration and espionage. It was during this period that the British "Asianized" the Special Branch, replacing its crop of British spies and officers with trained locals.[3]

Anwar Ibrahim scandal

In 1998, former Deputy Prime Minister Anwar Ibrahim was charged with sodomy and corruption, both crimes in Malaysia. During his trial, a number of statements were made by Special Branch officials, who had been implicated in the case.

One allegation made against Anwar was that he had ordered Special Branch officials to obtain retractions of the sodomy-related allegations against him. However, the Special Branch officials involved told the court that they had reason to believe the charges were fabricated by Anwar's political opponents. [4] Two Special Branch men involved were its then Director, Mohamed Said bin Awang, and Second Deputy Director, Amir bin Junus. One witness at the trial testified that Mohamed Said had told Anwar to allow the Special Branch to look into the matter, instead of Anwar directing the Special Branch to cover it up. [5]

During the trial, Mohamed Said shed light on the Special Branch's practices — mainly by explaining what was called a "turning-over operation", whereby retractions were obtained. At one point, he described it as a "great secret", and refused to elaborate beyond his explanation that "Basically we do a quick assessment on our target, then we see how the possibilities are to turn over their stand," and that "If it is a certain political stand, we may neutralize the stand if it is a security threat". [6] Mohamed Said later responded to the question "If someone higher than the deputy prime minister were to instruct you to come and lie to the court here, would you do it?" with "Depends on the situation." After being pressed for a clarification by the judge, he said, "I may or I may not". [7]

Present day

Raja Petra Kamarudin, a former detainee under the Internal Security Act (ISA), has claimed that when he was brought in for questioning, he was astonished by how well-informed they were about his activities: "It was astonishing that they had been able to take all those photographs of me without me realising it. It began to make me wonder whether they had any other photographs of me and my wife in my bedroom doing.....well, you know. ... It was as if they had been present in the meeting room, had participated in the meeting, and had tape-recorded the entire session. We might as well just admit our crime and sign the confession..." He also claimed that the Special Branch had successfully infiltrated the hierarchy of several political parties in the country. [2]
