SODOM - ANWAR - LOT

According to the Quran, Lot was a prophet and a nephew of Abraham. A group of angels visited Abraham as guests[8] and gave him glad tidings of a son "endowed with wisdom";[9] they told him that they had been sent by God to the "guilty people"[10] of Lot[11] to destroy them[12] with "a shower of stones of clay"[13] and deliver Lot and those who believed in him, except his wife saying "she is of those who lag behind".[14][15] The Qur'an also draws upon Lot's wife as an "example for the unbelievers" as she was married to a righteous man but cheated him by not believing in his message and was thus condemned to Hell.[16]
The people of Sodom and Gomorrah, the twin cities which Lot was sent to with God's message, transgressed consciously against the bounds of God. Their avarice led to inhospitality and robbery, which in turn led to the humiliation of strangers by mistreatment and rape. It was their abominable sin of homosexuality which was seen as symptomatic of their attitudes,[17][18] and upon Lot's exhorting them to abandon their transgression against God, they ridiculed him,[19] threatening with dire consequences;[20] Lot only prayed to God to be saved from doing as they did.[21]
Then two angels in the disguise of handsome young boys came to Lot, who became distressed knowing the character of the people, and feeling himself powerless to protect the visitors; he said, "This is a distressful day."[22] When the people – overjoyed at the news of new young boys in the village – came to snatch them away from Lot,[23] he tried to convince them to refrain from practising their lusts on the visitors, and offered his own daughters to them (to marry, according to the translation of Abdullah Yusuf Ali) in return for the boys' free release,[24][25] but they were unrelenting and replied "we have no need of your daughters: indeed you know quite well what we want!"[26] The Qur'an remarks "they moved blindly in the frenzy of approaching death".[27]
Lot was powerless to protect the boys, but they revealed to him that they were indeed angels sent by God to punish the people for their transgressions. They advised Lot to leave the place during the night and not look back, informing him that his wife would be left behind on account of her sinful nature and that they "were about to bring down upon the folk of this township a fury from the sky because they are evil-doers".[6] Keeping his faith in God, Lot left his home and the cities during the night with his family and others who believed in him, and only his wife stayed behind. When morning came, God turned the cities upside down, and rained down on them stones hard as baked clay,[28] putting an end to the lives of the people of Sodom and Gomorrah once and for all.

Anwar pleads not guilty on sodomy charge.

So Anwar pleads not guilty. As expected he blurted out this case as a bad slander. Is it true? So we have to wait until July, the see something out of the trial within time alocated, 24 days. Will there be videos or photographs as evidence? Being old, at 60 may not hold water, as more and more cases surface with much older guys for rape and sodomy.

Lets the court decide and whatever come out of it, then for the record, we just take it irrespective of losing or winning. Court is not always the place, for both parties to emerge as winners! A different process will make both parties happy, maybe arbitration or out of court settlement.

Trial fixed for July after Anwar pleads not guilty.

KUALA LUMPUR
Mac 11 2009

Opposition leader Datuk Seri Anwar Ibrahim pleaded not guilty at the High Court yesterday to committing carnal intercourse against the order of nature on his former aide in June last year.

"I claim trial. This is bad slander," he said after the court interpreter read the charge to him.

Anwar was charged with committing carnal intercourse against the order of nature on Mohd Saiful Bukhari Azlan, 24, at a condominium in Bukit Damansara here on June 26.

The case was heard before judge Mohamad Zabidin Mohd Diah after it was officially transferred to the High Court yesterday.

Anwar's lead counsel Sulaiman Abdullah told the court that the defence needed time to obtain full documents regarding the case, such as photographs, closed-circuit television camera recordings and DNA reports from the prosecution.
"We need to send these documents to our foreign experts. This will require more than a week," he said, adding that the defence had also filed an appeal over Zabidin's ruling on March 5.

Zabidin then ruled that the transfer certificate signed by Attorney-General Abdul Gani Patail was valid and therefore the case should be transferred to the High Court.

He fixed July 1 to 24 for trial.

Earlier yesterday, when the case was mentioned before Sessions Court judge Rozana Ali Yusoff, Sulaiman objected saying that the case should have been brought before the original judge hearing the case, S.M. Komathy Suppiah.

Komathy is on leave until Thursday.

Rozana, however, dismissed the objection, saying the High Court had made the order for the Sessions Court to transfer the case to the High Court and it was not necessary for the court to wait for Komathy.

"The case will not be prejudiced if it is transferred today," she said.

Outside the court, Anwar, who was accompanied by his wife, Datin Seri Wan Azizah Wan Ismail, said that as the case would be heard in July, he could now focus on three by-elections -- Bukit Gantang in Perak, Bukit Selambau in Kedah and Batang Ai in Sarawak -- which are all scheduled to be held on April 7.

SODOMY: Saiful takes aim at news site

Mohd Saiful Bukhari Azlan, who is also Mr Anwar's former aide, said the news portal published six articles claiming that he was critically ill due to the disease.

THE man who accused PKR de facto leader Datuk Seri Anwar Ibrahim of sodomising him has lodged a police report against Pahang Daily Online for posting articles on the Internet alleging that he had contracted a sexually transmitted disease (STD).

Mohd Saiful Bukhari Azlan, who is also Mr Anwar's former aide, said the news portal published six articles claiming that he was critically ill due to the disease.

Mohd Saiful, 23, refuted claims made on the news portal after lodging a report at the Damansara police station here yesterday.

'As you can see for yourselves, I am perfectly fine and healthy. I was not bedridden or ill as claimed by the website. I want to stress that I do not have an STD or any other sickness.

'These are all lies created by irresponsible people. I want the police to investigate and take immediate action against those responsible,' said Mohd Saiful, adding that he would file a suit against the news portal and others who spread similar lies via blogs and websites.

'There are also claims via e-mail and certain blogs that I am struck by bad luck for swearing on the Quran about my sodomy allegation against Anwar,' Mohd Saiful said, referring to an interview last month by a website with former Federal Territory Mosque imam Ramlang Porigi, who witnessed his oath-taking on Aug 15 last year.

Mohd Saiful, who arrived at the police station at 11am, was accompanied by his father Azlan Mohd Lazim, 55, and lawyer Zamri Idrus.

On June 28 last year, the former Universiti Tenaga Nasional student leader lodged a police report alleging that he was sodomised by Anwar at the Desa Damansara Condominium in Bukit Damansara on June 26. The case is pending in court. -- THE STAR/ANN

SODOMY TRIAL revisited.

Until March 5 whether
still Session Court
or High Court

Opposition leader Datuk Seri Anwar Ibrahim has to wait until Mar 5 to know if his sodomy trial will be retained in the Sessions Court or transferred to the High Court.

High Court judge Datuk Mohamad Zabidin Mohd Diah will decide then on the prosecution's application for a revision to quash the Sessions Court's decision to retain the trial in the Sessions Court.

Justice Mohamad Zabidin set the date after hearing submissions from deputy public prosecutor Datuk Mohamed Yusof Zainal Abiden, who led the prosecution team, and Anwar's lead counsel, Sulaiman Abdullah.

The prosecution filed for a revision as well as an appeal on Nov 7 last year against the Sessions Court's dismissal of the prosecution's application to transfer the case to the High Court after ruling that the transfer certificate, signed by Attorney-General Tan Sri Abdul Gani Patail, was invalid.

The defence had challenged the validity of the transfer certificate because Abdul Gani was still under investigation by the Anti-Corruption Agency following a police report lodged by Anwar on alleged falsification of evidence pertaining to the "black eye" incident.

The charge

Anwar, who was exempted from attending the hearing, is charged with sodomising his former aide, 23-year-old Mohamad Saiful Bukhari Azlan, at Unit 1151, Desa Damansara Condominium, Jalan Setiakasih, Bukit Damansara between 3.01pm and 4.30pm on June 26.

If convicted, Anwar, 62, faces imprisonment of up to 20 years under Section 377B of the Penal Code. He is now free on a personal bond of RM20,000.

The arguments

Earlier, Sulaiman submitted that Abdul Gani should be automatically disqualified from making any decision to transfer Anwar's case to the High Court because Abdul Gani was in a position of conflict of interest.

He said Abdul Gani before signing the transfer certificate must apply his mind to the facts before considering the reasons to transfer in view of the prime minister's assurance that he would not be involved in the case.

Sulaiman said this was supported by the fact that there was a personal dispute between Abdul Gani and Anwar, which had been made known to the government and public at large.

He cited a Singapore case where it was ruled that even where no bias or prejudice is being alleged against a judicial officer, a perception of conflict would be sufficient to disqualify the said officer.

"With that, there is extremely strong reason established for the AttorneyGeneral to disqualify himself from taking part in this case as well as in signing the transfer certificate," he said.

Therefore, the Sessions Court judge was correct in her finding that the transfer certificate was invalid, he said, adding that the judge was also competent to hear a public interest case.

While Mohamed Yusof replied that the prime minister's assurance that Abdul Gani would not be involved in the case meant in layman's terms that Abdul Gani would not be directly involved in the proceedings in court.

He also submitted that the Sessions Court judge had erred in law when she decided to entertain the defence's preliminary objection on the transfer certifate.

He said that under Section 418A of the Criminal Procedure Code, the subordinate courts had to transfer any case to the High Court upon the transfer certificate being tendered to the court.

ANWAR WITH MALAYSIAKINI: will there be sodomy video.

Will there be sodomy's video? A fifteen or 30 minutes or an hour long? Or a quickie 5 minute?

It is just a mental game stretching beyond what is obvious. To date, there have been 3 videos with record viewing! Sometimes ago, Lingam's tagline sounded really correct to everyone. It was household item. To make the matter even more interesting, Anwar slided in the video in phases. Such suspense. A thriller and a showcase of Don Juan seducing strategy. There was powww factor! [Lingam video guy]

Then Elizabeth Wong has herself waxed in Malaysian Madame Tussauds political waxhouse. She will stay there permanently endorsed by her trusted companions. It was only few photographs in the beginning but according to her but she feared the 30 minute video may surface. Nobody wish to guess the content of her most feared 30 minute video [ fears 30-minute video may surface]

Now Soi Lek's peculiarity is under the spotlight. It will tarnish his dimming image definitely, but what's worst is the overall image of chinese BN politicians. So now, Wong PKR one and Soi Lek MCA one.[Soi Lek]

Of the three, i will rate Soi lek as the sweetest because he is such a darling with nice, sweet and innocent look. Second will be Elizabeth Wong with her feminine enthusiasm and of course the third is Lingam. But Lingam put rings to the notion "See, i told you, i can do almost anything". What a triology of most interesting digitized graphical info ever shown to us Malaysians.

The next case will be Anwar's sodomy charge. With the earlier 3 videos [two out and one not yet], I am waiting for some kind of digitized graphical evidence to splash the current stinky political atmosphere. In short will there be video as evidence on the sodomy's charge. For the moment, nobody is saying anything. If there is one, damn if they keep us in suspense. Haha. "Damn you.. I am not going to watch Anwar in action packed video", said a friend as he was caffeinated with coffee during our rounds.

But is everything Ok with Anwar? Hakol Beseder B'Eli Haseder.

Raja Petra ordered to reveal source and reader IDs

By CECIL FUNG

KUALA LUMPUR: A High Court here has ordered Malaysia Today editor Raja Petra Kamarudin to reveal his sources for the allegations he made against lawyer Datuk Muhammad Shafee Abdullah in three online articles.

In addition, the wide-ranging order compels him to, within three days of its service to him, reveal the identities of visitors to his web portal who had left comments and messages following the articles.

In the three articles dated Aug 6, Aug 7 and Aug 11, Raja Petra had accused Shafee of masterminding the recent sodomy charge against PKR de facto leader Datuk Seri Anwar Ibrahim.

The order, granted by Justice Tee Ah Sing in chambers, also included several injunctions, the first of which directs Raja Petra to remove the defamatory articles from the web portal within two days as well as to remove any other follow up articles and comments posted by visitors.

Injunctions were also granted to restrain him or his agents from further publishing the said articles or any other articles, journals, letters, comments, posts and statements that are defamatory of Shafee on the web portal or any third party websites.

The order was the result of an ex parte summons in chambers filed by the lawyer, who had earlier Wednesday filed a defamation suit against the blogger over the same articles.

The court fixed Sept 2 to hear the inter partes application.

When contacted, Shafee said the order granted by the High Court was against "a blog owner who continuously, maliciously and contumeliously went on a rampage to defame me."

"I have not seen anything more defamatory than what this man has written. None of what he said is true," he said.

Shafee also challenged Raja Petra to enter appearance in this case and dared him to prove the truth of the contents of all three articles.

As at press time, the three articles were still available on the Malaysia Today portal.

Sufism, sodomy and Satan

Sigmund Freud thought that everything was about sex, and he was half right. Rarely is love so spiritual that it does not also stir the loins, for human beings are creatures not only of soul but of body. Although it is thought rude to say so nowadays, different kinds of love belong to different kinds of sex. Not even Hell can resist divine love, J W Goethe showed in the funniest vignette in all literature: his devil, Mephistopheles, is disabled by an obsessive lust for the cherubs sent to claim the soul of Faust in the drama’s penultimate scene. Heavenly beauty, that is, reduces the crafty demon to a pathetic old pervert, in a tableau not fit for a family newspaper.[1]

Goethe’s creepily convincing portrait of a pederastic devil in Faust (1832) drew on the poet’s earlier study of Persian love poetry of

the High Middle Ages,[2] where “as a rule, the beloved is not a woman, but a young man”, according to the leading Persian historian Ehsan Yar-Shater. Islamic mysticism (Sufism) of the High Middle Ages is the only case in which a mainstream current of a major world religion preached pederasty as a path to spiritual enlightenment. A vast literature documents this, and a great deal of it is available online.

Sufi adoration of pre-pubescent boys “persisted in many Islamic countries until very recent times,” according to the Orientalist Helmut Ritter.[3] The Afghan penchant for dancing boys in female costume, shown in the 2007 film The Kite Runner, is the last vestige of a Sufi practice that has been long suppressed by both the Sunni and Shi’ite branches of Islam. Sufism has a reputation in Western pop culture as a kinder and gentler branch of Islam. It is not a different kind of Islam, but rather Islam’s mystical practice, to which the adage applies, “by their fruits shall ye know them.”

Controversy persists over what is “authentic Sufism”. The Turkish organization of Fethallah Gulen claims millions of members and doubtless is the largest self-styled Sufi organization in the world. The American Sufi convert Stephen Schwartz has dismissed it as a “cult”,[4] while Michael Rubin of the American Enterprise Institute warns that Gulen may become the Turkish Khomeini. Given Turkey’s turn towards political Islam (Turkey in the throes of Islamic revolution?, Jul 22, 2008), the world is likely to find out a great deal more about Sufism in the near future, and well may be dismayed by what it learns.

In contrast to the Judeo-Christian West, where marriage has been a metaphor for God’s love since the Biblical Song of Songs, homosexual pederasty was normative for the Sufi philosopher-poets of Islam’s golden age in Central Asia. For Christians, the earthly adumbration of God’s love was nuptial, but pederastic in Muslim Persia. The classic Persian poets, including Hafez[5] and Rumi,[6] pined for beardless boys while their European contemporaries wrote sonnets to women. Some apologists claim that the Sufi practice of “contemplation of the beardless” was a chaste spiritual exercise, but an Egyptian proverb warns: “In his father's home a boy's chastity is safe, but let him become a dervish [Sufi adept] and the buggers will queue up behind him.”[7]

Sufi pedophilia cannot be dismissed as a remnant of the old tribal practices that Islam often incorporated, for example, female genital mutilation. Genital mutilation is a pre-Islamic practice unknown in the ancient and modern West. Even though some Muslim authorities defend it on the basis of Hadith, no one has ever claimed that it offered a path to enlightenment. Sadly, pedophiles are found almost everywhere. In its ascendancy, Sufism made a definitive spiritual experience out of a practice considered criminally aberrant in the West. But pederasty as a spiritual exercise is not essentially different in character from the furtive practices of Western perverts. As the psychiatrists explain, pederasty is an expression of narcissism, the love of an idealized youthful self-image.

Sufism seeks one-ness with the universe through spiritual exercises that lead individual consciousness to dissolve into the cosmos. But nothing is more narcissistic than the contemplation of the cosmos, for if we become one with the cosmos, what we love in the cosmos is simply an idealized image of ourselves. An idealized self-image is also what attracts the aging lecher to the adolescent boy. That is the secret of Sufi as well as other pederasty, for pederasty is an extreme expression of self-love. That is the conventional psychiatric view; Freud for example wrote of the “basic narcissism of the vast majority of pederasts … proceeding as from narcissism, they seek their own image in young people.”

Sufism enjoys a faddish ripple of interest in America, where self-admiration is the national pastime. As opposed to the Biblical God, the cosmos is an unthreatening thing to worship. The universe, after all, is no one in particular, and those who seek to merge their consciousness with no one in particular at the end are left alone with themselves. Worship the cosmos, and you worship yours truly; worship yourself, and it is not unusual to adore your own idealized image.

I do not mean to suggest that Sufis today are more likely to be pederasts than members of any other religious denomination. Sadly, there is brisk competition in that field. Karen Armstrong, the popular writer on religion, claims to be a Sufi, and I have it on good authority that she is not a pederast. Non-Muslims who embrace Sufism view it as a generic form of “spirituality”, like Madonna’s dabbling in what she thinks is Kabbalah. That recalls the joke about the Chinese waiter in a kosher restaurant who speaks perfect Yiddish, of whom the owner says, “He thinks he’s learning English.” No one should blame Hafez or Rumi for the casual interest of American spiritual tourists.

Nonetheless, it is not entirely by accident that Sufism holds a fascination for self-absorbed young Americans who dislike the demands placed upon them by revealed faith. Mysticism of this genre provides a pretext to worship one’s self in the masquerade of the universe. As Rumi (1207-1273), the most revered of the Sufi philosopher-poets, said of his own spiritual master,
Why should I seek? I am the same as
He. His essence speaks through me.
I have been looking for myself!
I do not speak Persian and cannot comment on the aesthetic quality of Rumi’s verse, which connoisseurs hold to be elegant. Its content, though, reduces to the same God-is-everywhere-and-all-I-have-to-do-is-look-inside-myself sort of platitudes of pop spirituality, for example,
I searched for God among the Christians and on the Cross and therein I found Him not.
I went into the ancient temples of idolatry; no trace of Him was there.
…
Then I directed my search to the Kaaba, the resort of old and young; God was not there even.
Turning to philosophy I inquired about him from ibn Sina but found Him not within his range.
I fared then to the scene of the Prophet's experience of a great divine manifestation only a 'two bow-lengths' distance from him' but God was not there even in that exalted court.
Finally, I looked into my own heart and there I saw Him; He was nowhere else.
If the point of love is to dissolve one's self into the All, then there is no difference between the self and the All; the self and the All are the same, and one loves one's self. There is no Other in Sufism, only your own ego grinning back from the universe. To embrace the cosmos implies the destruction of individuality. In Goethe’s drama, Faust conjures up the personification of the cosmos, the Earth Spirit, and cannot bear to look upon it; the Earth Spirit dismisses him with the epigram, “You are like the spirit whom you comprehend - not me!” Woe betide the adept who succeeds in merging his mind with the universe: he would become a monster, like Mephistopheles, the consummate nihilist.
Love of the cosmos reduces to idolatrous love of self. It is a radically different sort of love than the love of YHWH or Jesus, who are distinct beings with a personality, even if incomprehensible in their totality. The Judeo-Christian God is known to humankind by revelation, and specifically self-revelation through love. The revealed God seeks the love of humankind as an Other. Revelation does not reassure us that the Divine was in our hearts all along. It is not always a pleasant experience. It burns our lips like the kiss of a seraph, and casts our heart into the refiner’s fire. It shatters, burns, overwhelms and transforms us - but it does not dissolve us into a cosmic soup. On the contrary: it enhances our individual personality. Precisely because it reinforces our individuality, love in the Judeo-Christian world can be a very painful experience.

To Christians and Jews, God reveals himself as a personality, and through acts of love - the Exodus and the Resurrection. There is no such event in Islam. Allah does not reveals himself, that is, descend to earth; instead, he sends down from heaven his instruction manual, namely the Koran. Allah remains unknown, and ultimately indistinguishable from the nature in which he is embedded. Confronted by this absolutely transcendental entity the individual human personality shrivels into insignificance.

Mystical communion with an unrevealed and unknowable God demands the sort of star- and navel-gazing that brings the communicant right back to good old number one. Just as Rumi said, it’s all inside you, like the self-help books say. And that brings us back to the matter of pederasty.

Men and women are so different that the experience of heterosexual love is analogous to the spiritual encounter with the divine Other. Love is as strong as death, says the Song of Songs:
Set me as a seal upon thine heart, as a seal upon thine arm: for love is strong as death; jealousy is cruel as the grave: the coals thereof are coals of fire, which hath a most vehement flame. Many waters cannot quench love, neither can the floods drown it.
It is not only the passion of love that challenges death, but the

80-year-old accused in child sodomy case

An 80-year-old Columbia man is charged with first-degree statutory sodomy after allegedly fondling a 6-year-old girl last month.

Desilva

Everist C. Desilva, 80, of 2808 Jacobs Place, Apt. 4C, was arrested Aug. 4 by Columbia police. He was released from the Boone County Jail after posting a $50,000 bond.

According to a probable cause statement prepared by Columbia police Detective John Short, Desilva is accused of abusing the 6-year-old girl on July 30 at a residence on Calder Court while the girl was in Desilva’s care. She told her mother the next day that Desilva had touched her sexually and exposed himself to her, the court document said.

Desilva waived formal arraignment in court last week. He has a preliminary hearing set for Sept. 4.

On rape and personal responsibility

Here's a trick question: part I. When Brits on their summer holiday across (occasionally 35,000 feet above) sunny southern Europe get drunk, hospitalised and possibly jailed, whose fault is it?

Usually theirs, of course, though it's always interesting to hear how keen some of them are to blame the poor old British consul for not finding their stolen passport - or opening the front door at three in the morning.

It's all over page one of the Mail today, based on a Foreign Office reports which records a sharp rise in arrests - 2,032 in Spain last year, 1,415 in the US, 230 in Greece, on average 15% up.

In Spain 1,591 Brits died in 2006-07, which sounds like a lot of pool drownings until you remember the pensioners who live - and die - in the sun.

Junior Foreign Office minister, Meg Munn, was on the radio this morning, sensibly advising travellers to check the law and customs in countries they plan to visit. I often forget the French requirement that drivers must carry a triangle and fluorescent yellow jacket in the boot of the car. They can be very bureaucratic, the Frogs, though they tolerated sensational speeding until recently.

What Munn really meant, of course, was drink, drugs and sex. Apparently, not everyone heads south for sunshine or museums. Some go to get bladdered and laid, so they tell me. It's not just the grown-ups either. Teenagers, free from mum and dad, do it too.

Well, well. Serves them right, says me, if the Greek police take a less restrained view of their misconduct than they do down on the Quays in Newcastle-upon-Tyne. In socially conservative countries - as ours was until quite recently - being pissed, aggressively loud and half-naked isn't thought acceptable.

I realise the local boys take advantage of this deplorable phenomenon to get easy pickings, but hypocrisy is a universal trait, even among priests and mullahs, let alone barmen.

Now to part II of the trick question. Who's to blame when someone who's got drunk later gets raped, abroad or at home? Well, the rapist, of course. Rape is a very nasty crime, though a flamboyant Tory politician - Nicholas Fairbairn QC - who later lost his job as Mrs Thatcher's Scottish solicitor general once got into trouble for observing that it was very close to a normal activity. It's one reason among several (no witnesses) why prosecution is so difficult.

But what about compensation for rape victims? Just as today's Mail highlights the holiday binge drinkers on page one today, the Guardian carries a page one report under the headline Rape victims told alcoholic consumption may cost them compensation.

We learned that in the past year 14 rape victims have had their compensation trimmed by the Criminal Injuries Compensation Authority (CICA) because they had been drinking before they were attacked.

In the case of Helen - a beauty therapist who has not worked since being raped - she got 25% knocked off her £11,000 standard award. It felt like "a slap in the face", Helen told the paper.

She also gave an interview - read by an actor to protect her anonymity - to Radio 4's Today programme which, so I assume, must also have been given the story. The legal wrangle prolonged her distress, Helen seemed to be suggesting. Her lawyer was outraged.

The twist was that the CICA later changed its mind. It updated its response to the Guardian and BBC to say a mistake had been made in Helen's case: its policy is NOT to reduce awards to rape victims on the basis of alcohol consumption.

Today's Guardian editorial comment endorses that position, calling for a change in the rules on alcohol, in part on the grounds that for many women, those who do not see their attacker convicted, monetary compensation from the public purse is a form of recognition for their suffering.

I'm uneasy about this line of argument. Compensation for injury, civil and criminal, can be a pretty rough old business, with bomb victims sometimes getting much less than some pretty undeserving litigants who tripped on an uneven paving stone.

The Guardian acknowledges that drink "raises the risk of suffering rape, just as it increases the dangers of suffering from other violent crimes. No, the argument is that with rape there can be no divvying up of the blame."

Indeed not. But surely compensation is not about blame, that's a matter for the criminal law. It's about weighing up the injury, what long-term distress, financial outlay or even unemployment, it may cause, and - one factor among several - whether the actions of the claimant may have contributed to his/her misfortune. In sum, it's about personal responsibility.

If I get glassed in a pub during a fight which arose when I was drunk it's not quite the same as if I took the broken bottle in my eye as I soberly walked in, is it? If I wear conspicuously expensive clothes - or accent - and a Rolex watch in a rough part of town, drunk or sober, it's a crime to mug me. But, as the old saying goes, I was "asking for it" a bit, wasn't I?

It's rather like the police saying - as they rightly do - "don't carry a knife for protection, it may get you into trouble."

You put yourself at risk, just as you do by speeding when the idiot coming the other way loses control of the car: his fault, but you were going too fast or (another common one) tail-gating.

Yet I get into a lot of trouble with women friends whenever I suggest they have a responsibility to themselves to think about what they're wearing where they're wearing it. Ditto how much they drink. Ditto what I wear - and drink. Date rape drugs may be a problem, but rather less so than the happy hour, I suspect from the speed-drinking I see in bars.

The fact that people go to enormous lengths to deny this factor seems to me part of the problem, just as it is when bladdered stag party boys get stroppy with the consul when they lose their passport in Riga.

Everyone's a victim, no one's responsible. No wonder we have a discipline pandemic in school, at home and on the streets, not confined to the underclass either.

As for Brits, tourist or ex-pats doing drugs and sex-on-the-beach in places like Dubai, where appearances matter (as they once did here) they must be mad.

It's not Bradford or Barking, surely they can figure that out. For one thing it's hotter. That's why they're there. Or have they forgotten? Wonder why...

Sodomy: Net-ful of contradictory ‘proof’

Net-ful of contradictory ‘proof’

COMMENT
By BARADAN KUPPUSAMY

WHETHER Dr Mohamed Osman Abdul Hamid – the man at the centre of the latest controversy surrounding opposition icon Datuk Seri Anwar Ibrahim and the sodomy allegations– is in hiding or on an extended family holiday, is a moot point.

Like private investigator Balasubramaniam Perumal @ P.I. Bala, who fled the country on July 3 after retracting an explosive statutory declaration, Dr Mohamed Osman left behind many unanswered questions.

Dr Mohamed Osman @ Than Aung also set off a furious guessing game over who he really is and where he fits into the raging controversy centred on police investigation into a June 28 report made by Anwar’s aide Saiful Bukhari Azlan that the former deputy premier had sodomised him.

While mainstream newspapers are cautious, it is a free-for-all on the Internet with bloggers recklessly dissecting Dr Mohamed Osman’s explosive two-page medical report, if you can call it that, and posting their verdicts.

With powerful Internet search engines at their fingertips, no stone is left unturned.

“The frenzy is frightening. The innocent is declared guilty and the guilty presented as innocent. We don’t know what to believe,” said a lawyer who is keenly tracking the controversy.

“I have already accumulated a huge archive,” he said.

Dr Mohamed Osman might be a Burmese national but he is no stranger to Muslim organisations in Malaysia, especially missionary Muslim organisations like the Regional Islamic Da’wah Council of Southeast Asia and the Pacific or RISEAP (founded in 1980) for which he worked from 1993 to 1995.

According to the Malaysian Medical Council website he graduated from the University of Rangoon –Rangoon Medical College and having practised in various places, received a “full registration” in December 2005.

He worked between 1995 and 1998 in Lawas, Sarawak and then at the University Malaya Medical Centre.

His sojourn at the university hospital until 2007 coincides with the time Saiful was a student – setting off speculation on the Internet that there could be a connection between the two although what that is and how it figures in the current controversy is anybody’s guess.

Saiful was never at University Malaya but at Universiti Tenaga Nasional.

Some Internet writers are stretching it by connecting Dr Mohamed Osman with Anwar because for a while, (when Anwar was deputy prime Minister) he was a Supreme Council member of RISEAP which is a premier missionary organisation in the Asian region.

Other senior Malaysian politicians are also closely involved with RISEAP, so for Anwar to be a council member is nothing unusual.

But Internet conspiracy theories are not to be deterred by such thin links but happily hatching whole new threads linking the good doctor with the troubled politician and a worldwide network involving America, the World Bank and the IMF.

But then what is the Internet without its conspiracies.

Like P.I. Bala, Dr Mohamed Osman is “missing on the scene” but by now his medical report must have been read and dissected by millions of people both here and abroad.

Some blogs are not only deciphering the doctor’s difficult-to-read scrawl but also translations for Malay and Chinese readers.

According to reports Dr Mohamed Osman purportedly said in his report that there was “zero active bleeding,” “zero ulcer or pus” and “zero tear and scar” in the anus of Saiful.

He had also advised Saiful to go to a government hospital so as “to rule out” assault and sodomy.

For some the report’s authenticity is suspect while for Anwar the two-page document is evidence of his innocence.

He wants police to drop the case immediately and call it a day but Home Minister Datuk Seri Syed Hamid Albar has said the probe will continue to its natural conclusion.

In the meantime the country is hit by rumours of an imminent arrest of Anwar, fuelled once again by reports on the Internet.

“Many things have been said and reported that are not true,” said deputy IGP Tan Sri Ismail Omar. “Police have been very transparent and professional in handling this case.”

In time, his statement might turn out to be prophetic.

However any further delay in the investigation is unwelcome, not only by Malaysians but also by foreign investors whose nervousness at “where is this all leading too” is plain.

Transparency International Malaysia President Tan Sri Ramon Navaratnam says the investigation must be expedited in the light of the revelations of Dr Mohamed Osman’s report.

“It is a pressing issue and must be resolved without any further delay,” he said.

Saiful's blog hints of 'disclosures'

PETALING JAYA: Mohd Saiful Bukhari Azlan has set up his turf on the blogosphere and its title 'Demi Allah, Agama, Bangsa dan Negara' shows what might be expected from his postings.

So far, the blog has garnered 102 comments in three postings - some supporting and some scathingly critical of him, including one comment from an "anwar ibrahim".

In his latest posting, Saiful, the man who has accused Datuk Seri Anwar Ibrahim of sodomy, related his duties as a 'coffee boy' during his time in Anwar's camp.

Saiful claimed that he assisted Anwar's chief of staff in managing PKR's defacto leader’s schedule and arranged confidential meetings with MPs who had wanted to switch to the Opposition.

He said the meeting meetings took place at the Desa Damansara condominium, owned by a politician.

The entry went on to list three overseas trips on which he claimed he had accompanied Anwar: Hong Kong in early May, Bangkok in late May and Singapore from June 16 to 18.

Saiful urged his readers to be patient and wrote that he would disclose more in the courts later."

He also declared that he would make good on his promise to swear on the Quran now that the investigations into his police report against Anwar had been completed and submitted to the Attorney-General's Chambers.

"It's up to you to believe (my report) or not. Or to get DSAI (Anwar) to defend himself whether he's guilty or not," he wrote

He also wished Anwar the best in contesting - presumably referring to the Permatang Pauh parliamentary seat, which Datuk Seri Dr Wan Azizah Wan Ismail vacated for him on Thursday.

He ended the entry by saying that he prayed for the AG's Chambers to take up the case because he wanted 'KEADILAN' (justice).

The latest entry was not the first posting by Saiful.

His first one on July 7 received 96 comments with Saiful saying that he challenged Anwar with mubahalah - to invoke the curse of God to prove who is speaking the truth in the sodomy case between them.

He even called Anwar a munafik (a religious hypocrite) and stressed that the sodomy accusation was a private issue between them.

"As the victim, I have a right to be defended."

Malaysia opposition leader leaves safe haven

Allegra Stratton and agencies
guardian.co.uk,
Monday June 30, 2008

Malaysia's main opposition leader, Anwar Ibrahim, today left the Turkish ambassador's house in Kuala Lumpur where he sought refuge following accusations of sodomy.

The former deputy prime minister of Malaysia said that he had been offered safe haven in the Turkish ambassador's house after arriving at the embassy last night believing the government had plans to assassinate him.
Supporters feared he might be arrested after a 23-year year-old aide filed a complaint with the police accusing Anwar of sodomising him, which is punishable in Malaysia by up to 20 years in prison.
Anwar left the embassy today after receiving a government assurance about his safety.
"I pray that enough will be done for my security," Anwar said before climbing into his vehicle. "The new allegation is a repeat of the 1998 fiasco," he said.

The Trial of Anwar

July 01, 2008
THERE is good reason to be concerned about the dramatic turn of events in Malaysia, where opposition leader Anwar Ibrahim has been forced to claim sanctuary in a foreign embassy after new allegations of sodomy were made against him. The local police have promised a quick investigation of the claims, made by Mr Anwar's 23-year-old aide, that he was sexually assaulted by his boss in a Kuala Lumpur apartment. But Mr Anwar, who was politically crushed when he was imprisoned on similar charges a decade ago, is adamant the latest allegations represent the desperate actions of a government under pressure. To help build the picture of a conspiracy, Mr Anwar's supporters have produced photographs of his accuser at social functions with senior government officials.

Nonetheless, the allegations against Mr Anwar dent hopes of a smooth transition of power in Malaysia after 50 years of National Front rule. These hopes have been building since the ruling coalition, dominated by the United Malays National Organisation, suffered a collapse of support in the elections held on March 8. Mr Anwar was not eligible to take part in the poll, but the ban on his running for political office expired in April. Since then, he has been manoeuvring to weaken the ruling coalition and enter parliament through a by-election, with the aim of becoming prime minister.

Mr Anwar's political success has centred on his ability to broker an unlikely stable coalition that brings together the opposition Islamist Malay party, PAS, with the civil liberty concerns of Malaysia's ethnic Chinese and Indian minorities.

Mr Anwar's People's Justice Party, or Parti Keadilan Rakyat, won 82 seats with a group of allies in the 222-seat lower house of parliament in the March 8 vote. The alliance needs 30 more seats to replace the National Front coalition, and Mr Anwar was considered well on the way to achieving this target through defections.

The charge of sodomy is punishable by 20 years in jail in Malaysia, even if it is consensual. But the charge is rarely prosecuted, and given Mr Anwar's earlier experience, it is possible to believe the campaign against him is politically motivated.

Mr Anwar was identified internationally as a successor to Malaysia's long-serving prime minister Mohamad Mahathir, but he fell out of political favour in 1988 when he challenged Dr Mahathir's handling of the economy at the height of the Asian financial crisis. Mr Anwar was sacked by Dr Mahathir, and then charged with sodomy and corruption. Mr Anwar's conviction for sodomy was overturned by the Federal Court, and he was released from prison in 2004.

The latest allegations against Mr Anwar undermine hopes that Malaysia will become a model for peaceful democratic change in the Islamic world. The fresh tensions in the country coincide with rising political and economic troubles elsewhere in the region. Thailand is still experiencing street protests against the perceived influence of former prime minister Thaksin Shinawatra, who was ousted by a military coup in September 2006. And inflation is fuelling widespread political upheaval in India, Indonesia and The Philippines.

Against such a background, there were high hopes that confirmation of a healthy liberal democracy in Malaysia could help change the dynamic and political culture of Southeast Asia for the better. A re-run of the political dirty tricks campaign against Mr Anwar -- which his supporters claim is calculated to provoke street riots and allow the Government to invoke emergency powers -- has the potential to considerably set back the cause of democracy in the region. source:- http://www.theaustralian.news.com.au/

Malaysia's Anwar files suit against sodomy accusation, seeks government assurance of safety

The Associated Press
Published: June 30, 2008

KUALA LUMPUR, Malaysia: Malaysia's opposition leader Anwar Ibrahim filed a defamation lawsuit Monday against a male aide who accused him of sodomy, vowing to clear his name in the second sex scandal of his life to thrown the country's politics into turmoil.

"I went through hell before," Anwar told The Associated Press in a telephone interview, referring to the first upheaval a decade ago when he was accused of committing sodomy with his family driver and an aide.

The accusations led to his ouster as the deputy prime minister in 1998, when he was arrested and beaten up by the national police chief. A court later exonerated him.
Anwar, who recently revived his political career and is seen by some as the next prime minister, has denied the new sodomy accusation, dismissing it as a political conspiracy.
Anwar is now holed up in the Turkish Embassy, claiming he fears a government plot to kill him. He fled there early Sunday, hours after his 23-year-old male aide filed a police complaint accusing Anwar of sodomizing him.

Sodomy is punishable by 20 years' imprisonment in Muslim-majority Malaysia.
Anwar said he would not leave Malaysia or seek political asylum, but would remain in the embassy until "the government gives me a categorical undertaking for my personal safety."
"I was assaulted to near death before and my family and friends told me not to take things for granted," Anwar said. "I have every reason to suspect that it may recur again because they are more desperate now compared to 1998."

Anwar returned in spectacular fashion from political oblivion in the March 8 general elections, shepherding a three-party opposition alliance to massive gains that left the ruling National Front coalition with only a simple majority in Parliament for the first time in four decades.

He has since claimed to have persuaded dozens of government lawmakers to defect, and pledged to topple Prime Minister Abdullah Ahmad Badawi's administration by mid-September.
Anwar filed a defamation suit through his lawyers Monday in the Kuala Lumpur High Court, seeking unspecified compensation from his aide who made what Anwar branded as a "malicious" police complaint.

Anwar wants "to have his day in court as soon as possible and to further reinforce his position ... that this police report is a complete fabrication and is basically done as politically motivated," said his lawyer, Sivarasa Rasiah.

The developments have added to the turmoil in Malaysian politics, which last went through a major crisis in 1998 when then-Prime Minister Mahathir Mohamad fired Anwar, ostensibly over accusations that he sodomized his family driver.

Anwar was sentenced to 15 years in prison on what he claimed were trumped up charges of sodomy and abusing his authority to cover up the deed. Malaysia's highest court overturned the sodomy conviction in 2004 and freed him.

But the abuse-of-power conviction barred Anwar from political office for five years. The ban ended in April, and Anwar plans to re-enter Parliament through a by-election, which would make him eligible to become prime minister.

Anwar wrote on his blog Sunday that he has been warned "that my assassination has not been ruled out" in efforts to "end to the transformational changes taking place in Malaysia."
Anwar's party said the Turkish ambassador had offered him protection. Anwar is known to be a close friend of Turkey's Prime Minister Recep Tayyip Erdogan.

Deputy Prime Minister Najib Razak denied there was a conspiracy and said the government "can assure him of his personal safety."

"This is not a question of political persecution. This is a question of the law," he told reporters, adding the government would "never" harm a politician.
